If a sample does not meet the applicable testing standards <br />123.3 or if the testing facility is unable to test for a substance identified pursuant to subdivision <br />123.4 4, paragraph (b), the batch from which the sample was taken shall be subject to procedures <br />123.5 established by the office for such batches, including destruction, remediation, or retesting. <br />123.6 A cannabis microbusiness, cannabis mezzobusiness, cannabis cultivator, cannabis <br />123.7 manufacturer, cannabis wholesaler with an endorsement to import products, lower -potency <br />123.8 hemp edible manufacturer, medical cannabis cultivator, or medical cannabis processor must <br />123.9 maintain the test results for cannabis flower, cannabis products, artificially derived <br />123.10 cannabinoids, lower -potency hemp edibles, or hemp -derived consumer products grown, <br />123.11 manufactured, or imported by that cannabis business or he business for at least five years <br />123.12 after the date of testing. <br />123.13 (b) A cannabis microbusiness, cannabis mezzobusiness, cannabis cultivator, cannabis <br />123.14 manufacturer, cannabis wholesaler with an endorsement to import products, lower -potency <br />123.15 hemp edible manufacturer, medical cannabis cultivator, or medical cannabis processor shall <br />123.16 make test results maintained by that cannabis business or hemp business available for review <br />123.17 by any member of the public, upon request. Test results made available to the public must <br />123.18 be in plain language. <br />123.19 Sec. 62. [342.62] PACKAGING. <br />123.20 Subdivision 1. General. All cannabis flower, cannabis products, lower -potency hemp <br />123.21 edibles, and hemp -derived consumer products sold to customers or patients must be packaged <br />123.22 as required by this section and rules adopted under this chapter. <br />123.23 Subd. 2. Packaging requirements. (a) Except as provided in paragraph (b), all cannabis <br />123.24 flower, cannabis products, lower -potency hemp edibles, and hemp -derived consumer products <br />123.25 sold to customers or patients must be: <br />123.26 (1) prepackaged in packaging or a container that is plain, child -resistant, tamper -evident, <br />123.27 and opaque; or <br />123.28 (2) placed in packaging or a container that is plain, child -resistant, tamper -evident, and <br />123.29 opaque at the final point of sale to a customer. <br />123.30 (b) The requirement that packaging be child -resistant does not apply to a lower -potency <br />123.31 hemp edible that is sold pursuant to section 342.46, subdivision 8, paragraph (e), or: <br />123.32 (1) is intended to be consumed as a beverage; <br />123.33 (2) contains nonintoxicating cannabinoids; <br />Article 1 Sec. 62. 123 <br />
