HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />143.1 Subd. 3. Comparative negligence. Actions under this section are governed by section <br />143.2 604.01. <br />143.3 Subd. 4. Defense. It is a defense for the defendant to prove by a preponderance of the <br />143.4 evidence that the defendant reasonably and in good faith relied upon representations of <br />143.5 proof of age in selling, bartering, furnishing, or giving the cannabis flower, cannabis products, <br />143.6 lower -potency hemp edibles, or hemp -derived consumer products. <br />143.7 Subd. 5. Subrogation claims denied. There shall be no recovery by any insurance <br />143.8 company against any cannabis microbusiness, cannabis mezzobusiness, cannabis retailer, <br />143.9 or lower -potency hemp edible retailer under subrogation clauses of the uninsured, <br />143.10 underinsured, collision, or other first -party coverages of a motor vehicle insurance policy <br />143.11 as a result of payments made by the company to persons who have claims that arise in whole <br />143.12 or in part under this section. Section 65B.53, subdivision 3, does not apply to actions under <br />143.13 this section. <br />143.14 Subd. 6. Common law claims. Nothing in this chapter precludes common law tort claims <br />143.15 against any person 21 years old or older who knowingly provides or furnishes cannabis <br />143.16 flower, cannabis products, lower -potency hemp edibles, or hemp -derived consumer products <br />143.17 to a person under the age of 21 years. <br />143.18 Sec. 74. SUBSTANCE USE DISORDER ADVISORY COUNCIL FIRST MEETING. <br />143.19 The commissioner of human services shall convene the first meeting of the Substance <br />143.20 Use Disorder Advisory Council established under Minnesota Statutes, section 342.79, no <br />143.21 later than October 1, 2023. The members shall elect a chair at the first meeting. <br />143.22 Sec. 75. EFFECTIVE DATE. <br />143.23 Except as otherwise provided, each section of this article is effective July 1, 2023. <br />143.24 ARTICLE 2 <br />143.25 TAXES <br />143.26 Section 1. Minnesota Statutes 2022, section 270B.12, is amended by adding a subdivision <br />143.27 to read: <br />143.28 Subd. 4a. Office of Cannabis Management. The commissioner may disclose return <br />143.29 information to the Office of Cannabis Management for the purpose of and to the extent <br />143.30 necessary to administer section 270C.726. <br />143.31 EFFECTIVE DATE.
