HF100 NINTH ENGROSSMENT REVISOR BD 1­10100-9 <br />142.1 Subd. 3. Report and grants. (a) The commissioner of human services shall submit a <br />142.2 report of the grants and funding recommended by the advisory council to be awarded for <br />142.3 the upcoming fiscal year to the chairs and ranking minority members of the legislative <br />142.4 committees with jurisdiction over health and human services policy and finance by March <br />142.5 1 of each year, beginning March 1, 2024. <br />142.6 (b) When awarding grants, the commissioner of human services shall consider the <br />142.7 programs, projects, and initiatives recommended by the council that address the priorities <br />142.8 established by the council, unless otherwise appropriated by the legislature. <br />142.9 Sec. 72. [342.80] LAWFUL ACTIVITIES. <br />142.10 (a) Notwithstanding any law to the contrary, the cultivation, manufacturing, possessing, <br />142.11 and selling of cannabis flower, cannabis products, artificially derived cannabinoids, <br />142.12 lower -potency hemp edibles, and hemp -derived consumer products by a licensed cannabis <br />142.13 business or hemp business in conformity with the rights granted by a cannabis business <br />142.14 license or he business license is lawful and may not be the grounds for the seizure or <br />142.15 forfeiture of property, arrest or prosecution, or search or inspections except as provided by <br />142.16 this chapter. <br />142.17 (b) A person acting as an agent of a cannabis microbusiness, cannabis mezzobusiness, <br />142.18 cannabis retailer, or lower -potency hemp edible retailer who sells or otherwise transfers <br />142.19 cannabis flower, cannabis products, lower -potency hemp edibles, or hemp -derived consumer <br />142.20 products to a person under 21 years of age is not subject to arrest, prosecution, or forfeiture <br />142.21 of property if the person complied with section 342.27, subdivision 4, and any rules <br />142.22 promulgated pursuant to this chapter. <br />142.23 Sec. 73. [342.811 CIVIL ACTIONS. <br />142.24 Subdivision 1. Right of action. A spouse, child, parent, guardian, employer, or other <br />142.25 person injured in person, property, or means of support or who incurs other pecuniary loss <br />142.26 by an intoxicated person or by the intoxication of another person, has a right of action in <br />142.27 the person's own name for all damages sustained against a person who caused the intoxication <br />142.28 of that person by illegally selling cannabis flower, cannabis products, lower -potency hemp <br />142.29 edibles, or hemp -derived consumer products. All damages recovered by a minor under this <br />142.30 section must be paid either to the minor or to the minor's parent, guardian, or next friend as <br />142.31 the court directs. <br />142.32 Subd. 2. Actions. All suits for damages under this section must be by civil action in a <br />142.33 court of this state having jurisdiction. <br />Article 1 Sec. 73. 142 <br />
