HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />179.1 (5) the person unlawfully possesses one or more mixtures of a total weight of 500 grams <br />179.2 or more containing amphetamine, phencyclidine, or hallucinogen or, if the controlled <br />179.3 substance is packaged in dosage units, equaling 500 or more dosage units; or <br />179.4 (6) the person unlawfully possesses <br />179.5 , Af possesses 500 of <br />179.E mofe .. <br />179.7 (i) 50 kilograms or more of cannabis flower; <br />179.8 (ii) ten kilograms or more of cannabis concentrate; or <br />179.9 (iii) edible cannabis products, lower -potency hemp edibles, hemp -derived consumer <br />179.10 products, or any combination of those infused with more than one kilogram of <br />179.11 tetrahydrocannabinols. <br />179.12 (b) For the purposes of this subdivision, the weight of fluid used in a water pipe may <br />179.13 not be considered in measuring the weight of a mixture except in cases where the mixture <br />179.14 contains four or more fluid ounces of fluid. <br />179.15 EFFECTIVE DATE. This section is effective August 1, 2023, and applies to crimes <br />179.16 committed on or after that date. <br />179.17 Sec. 11. Minnesota Statutes 2022, section 152.022, subdivision 1, is amended to read: <br />179.18 Subdivision 1. Sale crimes. A person is guilty of controlled substance crime in the <br />179.19 second degree if: <br />179.20 (1) on one or more occasions within a 90-day period the person unlawfully sells one or <br />179.21 more mixtures of a total weight of ten grams or more containing a narcotic drug other than <br />179.22 heroin; <br />179.23 (2) on one or more occasions within a 90-day period the person unlawfully sells one or <br />179.24 more mixtures of a total weight of three grams or more containing cocaine or <br />179.25 methamphetamine and: <br />179.26 (i) the person or an accomplice possesses on their person or within immediate reach, or <br />179.27 uses, whether by brandishing, displaying, threatening with, or otherwise employing, a <br />179.28 firearm; or <br />179.29 (ii) the offense involves three aggravating factors; <br />179.30 (3) on one or more occasions within a 90-day period the person unlawfully sells one or <br />179.31 more mixtures of a total weight of three grams or more containing heroin; <br />Article 4 Sec. 11. 179 <br />
