HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />180.1 (4) on one or more occasions within a 90-day period the person unlawfully sells one or <br />180.2 more mixtures of a total weight of ten grams or more containing amphetamine, phencyclidine, <br />180.3 or hallucinogen or, if the controlled substance is packaged in dosage units, equaling 50 or <br />180.4 more dosage units; <br />180.s <br />180.E <br />180.7 , <br />180.8 (6)� the person unlawfully sells any amount of a Schedule I or II narcotic drug to a <br />i 80.9 person under the age of 18, or conspires with or employs a person under the age of 18 to <br />i 80. i o unlawfully sell the substance; or <br />180.11 (7)� the person unlawfully sells any of the following in a school zone, a park zone, a <br />180.12 public housing zone, or a drug treatment facility: <br />180.13 (i) any amount of a Schedule I or II narcotic drug, lysergic acid diethylamide (LSD), <br />180.14 3,4-methylenedioxy amphetamine, or 3,4-methylenedioxymethamphetamine; or <br />180.15 (ii) one or more mixtures containing methamphetamine or amphetamine_ <br />180.16 <br />180.17 <br />180.18 EFFECTIVE DATE. This section is effective January 1, 2024, and applies to crimes <br />180.19 committed on or after that date. <br />180.20 Sec. 12. Minnesota Statutes 2022, section 152.022, subdivision 2, is amended to read: <br />180.21 Subd. 2. Possession crimes. (a) A person is guilty of controlled substance crime in the <br />180.22 second degree if: <br />180.23 (1) the person unlawfully possesses one or more mixtures of a total weight of 25 grams <br />180.24 or more containing cocaine or methamphetamine; <br />180.25 (2) the person unlawfully possesses one or more mixtures of a total weight of ten grams <br />180.26 or more containing cocaine or methamphetamine and: <br />180.27 (i) the person or an accomplice possesses on their person or within immediate reach, or <br />180.28 uses, whether by brandishing, displaying, threatening with, or otherwise employing, a <br />180.29 firearm; or <br />180.30 (ii) the offense involves three aggravating factors; <br />Article 4 Sec. 12. 180 <br />
