HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />184.1 EFFECTIVE DATE. This section is effective January 1, 2024, and applies to crimes <br />184.2 committed on or after that date. <br />184.3 Sec. 17. Minnesota Statutes 2022, section 152.025, subdivision 2, is amended to read: <br />184.4 Subd. 2. Possession and other crimes. A person is guilty of controlled substance crime <br />184.5 in the fifth degree and upon conviction may be sentenced as provided in subdivision 4 if: <br />184.6 (1) the person unlawfully possesses one or more mixtures containing a controlled <br />184.7 substance classified in Schedule I, II, III, or IV, except cannabis <br />184.8 flower, cannabis products, lower -potency hemp edibles, or hemp -derived consumer products; <br />184.9 or <br />184.10 (2) the person procures, attempts to procure, possesses, or has control over a controlled <br />184.11 substance by any of the following means: <br />184.12 (i) fraud, deceit, misrepresentation, or subterfuge; <br />184.13 (ii) using a false name or giving false credit; or <br />184.14 (iii) falsely assuming the title of, or falsely representing any person to be, a manufacturer, <br />184.15 wholesaler, pharmacist, physician, doctor of osteopathic medicine licensed to practice <br />184.16 medicine, dentist, podiatrist, veterinarian, or other authorized person for the purpose of <br />184.17 obtaining a controlled substance. <br />184.18 EFFECTIVE DATE. This section is effective August 1, 2023, and applies to crimes <br />184.19 committed on or after that date. <br />184.20 Sec. 18. [152.0263] CANNABIS POSSESSION CRIMES. <br />184.21 Subdivision 1. Possession of cannabis in the first degree. A person is guilty of cannabis <br />184.22 possession in the first degree and may be sentenced to imprisonment of not more than five <br />184.23 years or to payment of a fine of not more than $10,000, or both, if the person unlawfully <br />184.24 possesses any of the following: <br />184.25 (1) more than 1.5 pounds but not more than ten kilograms of cannabis flower; <br />184.26 (2) more than 160 grams but not more than two kilograms of cannabis concentrate; or <br />184.27 (3) edible cannabis products, lower -potency hemp edibles, or hemp -derived consumer <br />184.28 products infused with more than 16 grams but not more than 200 grams of <br />184.29 tetrahydrocannabinol. <br />Article 4 Sec. 18. 184 <br />
