HF100 NINTH ENGROSSMENT REVISOR BD 110100-9 <br />185.1 Subd. 2. Possession of cannabis in the second degree. A person is guilty of cannabis <br />185.2 possession in the second degree and may be sentenced to imprisonment of not more than <br />185.3 one year or to payment of a fine of not more than $3,000, or both, if the person unlawfully <br />185.4 possesses any of the following: <br />185.5 (1) more than one hound but not more than 1.5 hounds of cannabis flower in anv place <br />185.6 other than the person's residence; <br />185.E (2) more than 80 grams but not more than 160 grams of cannabis concentrate; or <br />185.8 (3) edible cannabis products, lower -potency hemp edibles, or hemp -derived consumer <br />185.9 products infused with more than eight grams but not more than 16 grams of <br />185.10 tetrahydrocannabinol. <br />185.11 Subd. 3. Possession of cannabis in the third degree. A person is guilty of cannabis <br />185.12 possession in the third degree and may be sentenced to imprisonment of not more than 90 <br />185.13 days or to payment of a fine of not more than $1,000, or both, if the person unlawfully <br />185.14 possesses any of the following: <br />185.15 (1) more than four ounces but not more than one pound of cannabis flower in any place <br />185.16 other than the person's residence; <br />185.17 (2) more than 16 grams but not more than 80 grams of cannabis concentrate; or <br />185.18 (3) edible cannabis products, lower -potency hemp edibles, or hemp -derived consumer <br />185.19 products infused with more than 1,600 milligrams but not more than eight grams of <br />185.20 tetrahydrocannabinol. <br />185.21 Subd. 4. Possession of cannabis in the fourth degree. A person is guilty of a petty <br />185.22 misdemeanor if the person unlawfully possesses any of the following: <br />185.23 (1) more than two ounces but not more than four ounces of cannabis flower in any place <br />185.24 other than the person's residence; <br />185.25 (2) more than eight grams but not more than 16 grams of cannabis concentrate; or <br />185.26 (3) edible cannabinoid products infused with more than 800 milligrams but not more <br />185.27 than 1.600 milligrams of tetrahvdrocannabinol. <br />185.28 Subd. 5. Use of cannabis in public. A local unit of government may adopt an ordinance <br />185.29 establishing a petty misdemeanor offense for a person who unlawfully uses cannabis flower, <br />185.30 cannabis products, lower -potency hemp edibles, or hemp -derived consumer products in a <br />185.31 public place provided that the definition of public place does not include the following: <br />185.32 (1) a private residence, including the person's curtilage or yard; <br />Article 4 Sec. 18. 185 <br />
