HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />187.1 Subd. 3. Sale of cannabis in the third degree. A person is guilty of sale of cannabis in <br />187.2 the third degree and may be sentenced to imprisonment of not more than 90 days or to <br />187.3 payment of a fine of not more than $1,000, or both, if the person unlawfully sells: <br />187.4 (1) more than two ounces of cannabis flower; <br />187.5 (2) more than eight grams of cannabis concentrate; or <br />187.6 (3) edible cannabis products, lower -potency hemp edibles, or hemp -derived consumer <br />187.7 products infused with more than 800 milligrams of tetrahydrocannabinol. <br />187.8 Subd. 4. Sale of cannabis in the fourth degree. (a) A person is guilty of a petty <br />187.9 misdemeanor if the Berson unlawfullv sells: <br />187.10 (1) not more than two ounces of cannabis flower; <br />187.11 (2) not more than eight grams of cannabis concentrate; or <br />187.12 (3) edible cannabis products, lower -potency hemp edibles, or hemp -derived consumer <br />187.13 products infused with not more than 800 milligrams of tetrahydrocannabinol. <br />187.14 (b) A sale for no remuneration by an individual over the age of 21 to another individual <br />187.15 over the age of 21 is not an unlawful sale under this subdivision. <br />187.16 Subd. 5. Sale of cannabis by a minor. (a) A minor is guilty of a petty misdemeanor if: <br />187.17 (1) the minor unlawfully sells cannabis flower, cannabis concentrate, cannabis products, <br />187.18 lower -potency hemp edibles, or hemp -derived consumer products; and <br />187.19 (2) the minor has not previously received a petty misdemeanor disposition or been <br />187.2o adjudicated delinquent for committing an act in violation of this section. <br />187.21 (b) A minor sentenced under this subdivision is required to participate in a drug education <br />187.22 program unless the court enters a written finding that a drug education program is <br />187.23 inappropriate. The program must be approved by an area mental health board with a <br />187.24 curriculum approved by the state alcohol and drug abuse authority. <br />187.25 (c) A minor who receives a disposition pursuant to this subdivision is required to perform <br />187.26 community service. <br />187.27 EFFECTIVE DATE. This section is effective January 1, 2024, and applies to crimes <br />187.28 committed on or after that date. <br />Article 4 Sec. 19. 187 <br />
