HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />188.1 Sec. 20. [152.0265] CANNABIS CULTIVATION CRIMES. <br />188.2 Subdivision 1. Cultivation of cannabis in the first degree. A person is guilty of <br />188.3 cultivation of cannabis in the first degree and may be sentenced to imprisonment of not <br />188.4 more than five years or to payment of a fine of not more than $10,000, or both, if the person <br />188.5 unlawfully cultivates more than 23 cannabis plants. <br />188.6 Subd. 2. Cultivation of cannabis in the second degree. A person is guilty of cultivation <br />188.E of cannabis in the second decree and may be sentenced to imprisonment of not more than <br />188.8 one year or to payment of a fine of not more than $3,000, or both, if the person unlawfully <br />188.9 cultivates more than 16 cannabis plants but not more than 23 cannabis plants. <br />188.10 EFFECTIVE DATE. This section is effective August 1, 2023, and applies to crimes <br />188.11 committed on or after that date. <br />188.12 Sec. 21. Minnesota Statutes 2022, section 152.11. subdivision 2, is amended to read: <br />188.13 Subd. 2. Prescription requirements for Schedule III or IV controlled substances. (a) <br />188.14 Except as provided in paragraph (b), no person may dispense a controlled substance included <br />188.15 in Schedule III or IV of section 152.02 without a prescription issued, as permitted under <br />188.16 subdivision 1, by a doctor of medicine, a doctor of osteopathic medicine licensed to practice <br />188.17 medicine, a doctor of dental surgery, a doctor of dental medicine, a doctor of podiatry, a <br />188.18 doctor of optometry limited to Schedule IV, or a doctor of veterinary medicine, lawfully <br />188.19 licensed to prescribe in this state or from a practitioner licensed to prescribe controlled <br />188.20 substances by the state in which the prescription is issued, and having a current federal drug <br />188.21 enforcement administration registration number. Such prescription may not be dispensed <br />188.22 or refilled except with the documented consent of the prescriber, and in no event more than <br />188.23 six months after the date on which such prescription was issued and no such prescription <br />188.24 may be refilled more than five times. <br />188.25 (b) This subdivision does not apply to cannabis plants, cannabis flower, cannabis products, <br />188.26 or hemp -derived consumer products sold or transferred in compliance with chapter 342. <br />188.27 Sec. 22. Minnesota Statutes 2022, section 169A.03, is amended by adding a subdivision <br />188.28 to read: <br />188.29 Subd. 3 a. Artificially derived cannabinoid. "Artificially derived cannabinoid" has the <br />188.30 meaning given in section 342.01, subdivision 6. <br />Article 4 Sec. 22. 188 <br />
