HF100 NINTH ENGROSSMENT REVISOR BD 110100-9 <br />215.1 charges related to the production, processing, sale or distribution, and possession of medical <br />215.2 cannabis flower and medical cannabinoid products. <br />215.3 Subd. 5. Civil and criminal immunities. The following acts, when performed by a <br />215.4 validly licensed medical cannabis retailer or an employee of a medical cannabis retailer <br />215.5 operated by an Indian Tribe pursuant to a compact entered into under this section, do not <br />215.6 constitute a criminal or civil offense under state law: <br />215.7 (1) the cultivation of cannabis flower, as defined in section 342.01, subdivision 15; <br />215.8 (2) the possession, purchase, and receipt of medical cannabis flower and medical <br />215.9 cannabinoid products that are properly packaged and labeled as authorized under a compact <br />215.1 o entered into pursuant to this section; and <br />215.11 (3) the delivery, distribution, and sale of medical cannabis flower and medical cannabinoid <br />215.12 products as authorized under a compact entered into pursuant to this section and that takes <br />215.13 place on the premises of a medical cannabis retailer on Tribal land to any person 21 years <br />215.14 of age or older. <br />215.15 Subd. 6. Publication; report. (a) The governor shall post any compact entered into <br />215.16 under this section on a Dubliclv accessible website. <br />215.17 (b) The governor, the attorney general, and the governor's designated representatives <br />215.18 shall report to the legislative committees having jurisdiction over health, taxation, and <br />215.19 commerce annually. This report shall contain information on compacts negotiated and an <br />215.20 outline of prospective negotiations. <br />215.21 Sec. 2. [3.9228] ADULT -USE CANNABIS; COMPACTS TO BE NEGOTIATED. <br />215.22 Subdivision 1. Definitions. (a) As used in this section, the following terms have the <br />215.23 meanings given. <br />215.24 (b) "Adult -use cannabis flower" has the meaning given in section 342.01, subdivision <br />215.25 4. <br />215.26 (c) "Adult -use cannabinoid product" has the meaning given in section 342.01, subdivision <br />215.27 2. <br />215.28 (d) "Cannabis business" means a cannabis cultivator. manufacturer. retailer. wholesaler <br />215.29 transporter, testing facility, microbusiness, event organizer, delivery service, or lower <br />215.30 potency edible retailer. <br />215.31 (e) "Cannabinoid product" has the meaning given in section 342.01, subdivision 12. <br />Article 6 Sec. 2. 215 <br />
