HF100 NINTH ENGROSSMENT REVISOR BD 110100-9 <br />219.1 entered into pursuant to this section, and the sale, delivery, transport, or distribution of such <br />219.2 products to a licensed cannabis business; and <br />219.3 (3) the delivery, distribution, and sale of adult -use cannabis seed, flower, and adult -use <br />219.4 cannabinoid products as authorized under a compact entered into pursuant to this section <br />219.5 and that takes place on, or originates from, the premises of a Tribal cannabis business on <br />219.6 Tribally regulated land, to any person 21 years of age or older. <br />219.7 (b) The following acts, when performed by a patron of a licensed Tribal cannabis business <br />219.8 do not constitute a criminal or civil offense under state law: the purchase, possession, or <br />219.9 receipt of adult -use cannabis seed, flower, and adult -use cannabinoid products as authorized <br />219.10 under a compact entered into pursuant to this section. <br />219.11 (c) Actions by a Tribal cannabis business, a Tribal member, employee, or agent of a <br />219.12 Minnesota Tribal government or Tribal cannabis business on Tribally regulated land pursuant <br />219.13 to Tribal laws governing cannabis, or a compact entered into under this section, do not <br />219.14 constitute a criminal or civil offense under state law. <br />219.15 (d) The following acts, when performed by a state -licensed cannabis business, or an <br />219.16 employee of such business, and which would be permitted under the terms of the applicable <br />219.17 cannabis business license if undertaken with another state -licensed cannabis business, are <br />219.18 permitted under the state license conditions when undertaken with a Tribal cannabis business <br />219.19 and do not constitute a criminal or civil offense under state law: the possession, purchase, <br />219.20 wholesale and retail sale, delivery, transport, distribution, and receipt of adult -use cannabis, <br />219.21 seed, flower, and adult -use cannabinoid products that are properly packaged and labeled as <br />219.22 authorized under a compact entered into pursuant to this section. <br />219.23 (e) The following acts, when performed by a Minnesota Tribal government, a Tribal <br />219.24 cannabis business licensed by such Tribal government, or an employee of such Tribal <br />219.25 government or Tribal cannabis business, regardless of whether the Minnesota Tribal <br />219.26 government issuing such license has compacted with the state under this section, do not <br />219.27 constitute a criminal or civil offense under state law: purchase, sale, receipt, or delivery <br />219.28 (including delivery that involves transit through the state, outside a reservation), from or to <br />219.29 another Minnesota Tribal government or cannabis business licensed by such government. <br />219.30 (f) Notwithstanding any other provision of law, a state -licensed cannabis testing facility <br />219.31 may provide cannabis testing services to a Tribal cannabis business, and the possession or <br />219.32 transport of cannabis flower or cannabinoid products for such purpose by a Tribal cannabis <br />219.33 business shall not constitute a criminal or civil offense under state law. <br />219.34 (g) This subdivision shall be effective upon enactment. <br />Article 6 Sec. 2. 219 <br />
