HF100 NINTH ENGROSSMENT REVISOR BD 1­10100-9 <br />226.1 Sec. 15. Minnesota Statutes 2022, section 181.950, subdivision 5, is amended to read: <br />226.2 Subd. 5. Drug and alcohol testing. "Drug and alcohol testing," "drug or alcohol testing," <br />226.3 and "drug or alcohol test" mean analysis of a body component sample according to the <br />226.4 standards established under one of the programs listed in section 181.953, subdivision 1, <br />226.5 for the purpose of measuring the presence or absence of drugs, alcohol, or their metabolites <br />226.6 in the sample tested. "Drug and alcohol testing," "drug or alcohol testing," and "drug or <br />226.7 alcohol test" do not include cannabis or cannabis testing, unless stated otherwise. <br />226.8 Sec. 16. Minnesota Statutes 2022, section 181.950, is amended by adding a subdivision <br />226.9 to read: <br />226.10 Subd. 5a. Cannabis testing. "Cannabis testing" means the analysis of a body component <br />226.11 sample according to the standards established under one of the programs listed in section <br />226.12 181.953, subdivision 1, for the purpose of measuring the presence or absence of cannabis <br />226.13 flower, as defined in section 342.01, subdivision 15, cannabis products, as defined in section <br />226.14 342.01, subdivision 19, lower -potency hemp edibles as defined in section 342.01, subdivision <br />226.15 48, hemp -derived consumer products as defined in section 342.01, subdivision 35, or cannabis <br />226.16 metabolites in the sample tested. The definitions in this section apply to cannabis testing <br />226.17 unless stated otherwise. <br />226.18 Sec. 17. Minnesota Statutes 2022, section 181.950, subdivision 8, is amended to read: <br />226.19 Subd. 8. Initial screening test. "Initial screening test" means a drug or alcohol test or <br />226.20 cannabis test which uses a method of analysis under one of the programs listed in section <br />226.21 181.953, subdivision 1. <br />226.22 Sec. 18. Minnesota Statutes 2022, section 181.950, subdivision 13, is amended to read: <br />226.23 Subd. 13. Safety -sensitive position. "Safety -sensitive position" means a job, including <br />226.24 any supervisory or management position, in which an impairment caused by drug or, alcohol, <br />226.25 or cannabis usage would threaten the health or safety of any person. <br />226.26 Sec. 19. Minnesota Statutes 2022, section 181.951, subdivision 4, is amended to read: <br />226.27 Subd. 4. Random testing. An employer may request or require employees to undergo <br />226.28 cannabis testing or drug and alcohol testing on a random selection basis only if (1) they are <br />226.29 employed in safety -sensitive positions, or (2) they are employed as professional athletes if <br />226.30 the professional athlete is subject to a collective bargaining agreement permitting random <br />226.31 testing but only to the extent consistent with the collective bargaining agreement. <br />Article 6 Sec. 19. 226 <br />
