<br />225.1 Sec. 12. Minnesota Statutes 2022, section 181.938, subdivision 2, is amended to read:
<br />225.2 Subd. 2. Prohibited practice. (a) An employer may not refuse to hire a job applicant
<br />225.3 or discipline or discharge an employee because the applicant or employee engages in or has
<br />225.4 engaged in the use or enjoyment of lawful consumable products, if the use or enjoyment
<br />225.5 takes place off the premises of the employer during nonworking hours. For purposes of this
<br />225.6 section, "lawful consumable products" means products whose use or enjoyment is lawful
<br />225.E and which are consumed during use or enjoyment, and includes food, alcoholic or
<br />225.8 nonalcoholic beverages, and tobacco, cannabis flower, as defined in section 342.01,
<br />225.9 subdivision 15, cannabis products, as defined in section 342.01, subdivision 19,
<br />225.10 lower -potency hemp edibles as defined in section 342.01, subdivision 48, and hemp -derived
<br />225.11 consumer products as defined in section 342.01, subdivision 35.
<br />225.12 (b) Cannabis flower, cannabis products, lower -potency hemp edibles, and hemp -derived
<br />225.13 consumer products are lawful consumable products for the purpose of Minnesota law,
<br />225.14 regardless of whether federal or other state law considers cannabis use, possession,
<br />225.15 impairment, sale, or transfer to be unlawful. Nothing in this section shall be construed to
<br />225.16 limit an employer's ability to discipline or discharge an employee for cannabis flower,
<br />225.17 cannabis product, lower -potency hemp edible, or hemp -derived consumer product use,
<br />225.18 possession, impairment, sale, or transfer during working hours, on work premises, or while
<br />225.19 operating an employer's vehicle, machinery, or equipment, or if a failure to do so would
<br />225.20 violate federal or state law or regulations or cause an employer to lose a monetary or
<br />225.21 licensing -related benefit under federal law or regulations.
<br />225.22 Sec. 13. Minnesota Statutes 2022, section 181.950, subdivision 2, is amended to read:
<br />225.23 Subd. 2. Confirmatory test; confirmatory retest. "Confirmatory test" and "confirmatory
<br />225.24 retest" mean a drug or alcohol test or cannabis test that uses a method of analysis allowed
<br />225.25 under one of the programs listed in section 181.953, subdivision 1.
<br />225.26 Sec. 14. Minnesota Statutes 2022, section 181.950, subdivision 4, is amended to read:
<br />225.27 Subd. 4. Drug. "Drug" means a controlled substance as defined in section 152.01,
<br />225.28 subdivision 4, but does not include marijuana, tetrahydrocannabinols, cannabis flower as
<br />225.29 defined in section 342.01, subdivision 15, cannabis products as defined in section 342.01,
<br />225.30 subdivision 19, lower -potency hemp edibles as defined in section 342.01, subdivision 48,
<br />225.31 and hemp -derived consumer products as defined in section 342.01, subdivision 35.
