HF100 NINTH ENGROSSMENT REVISOR BD 1­10100-9 <br />244.1 Sec. 39. Minnesota Statutes 2022, section 504B.171, subdivision I. is amended to read: <br />244.2 Subdivision 1. Terms of covenant. (a) In every lease or license of residential premises, <br />244.3 whether in writing or parol, the landlord or licensor and the tenant or licensee covenant that: <br />244.4 (1) neither will: <br />244.5 (i) unlaw allow controlled substances in those premises or in the common area and <br />244.6 curtilage of the premises in violation of any criminal provision of chapter 152; <br />244.7 (ii) allow prostitution or prostitution -related activity as defined in section 617.80, <br />244.8 subdivision 4, to occur on the premises or in the common area and curtilage of the premises; <br />244.9 (iii) allow the unlawful use or possession of a firearm in violation of section 609.66, <br />244.10 subdivision la, 609.67, or 624.713, on the premises or in the common area and curtilage of <br />244.11 the premises; or <br />244.12 (iv) allow stolen property or property obtained by robbery in those premises or in the <br />244.13 common area and curtilage of the premises; and <br />244.14 (2) the common area and curtilage of the premises will not be used by either the landlord <br />244.15 or licensor or the tenant or licensee or others acting under the control of either to manufacture, <br />244.16 sell, give away, barter, deliver, exchange, distribute, purchase, or possess a controlled <br />244.17 substance in violation of any criminal provision of chapter 152. The covenant is not violated <br />244.18 when a person other than the landlord or licensor or the tenant or licensee possesses or <br />244.19 allows controlled substances in the premises, common area, or curtilage, unless the landlord <br />244.20 or licensor or the tenant or licensee knew or had reason to know of that activity. <br />244.21 (b) In every lease or license of residential premises, whether in writing or parol, the <br />244.22 tenant or licensee covenant that the tenant or licensee will not commit an act enumerated <br />244.23 under section 504B.206, subdivision 1, paragraph (a), against a tenant or licensee or any <br />244.24 authorized occupant. <br />244.25 (c) A landlord cannot prohibit a tenant from legally possessing, and a tenant cannot <br />244.26 waive the right to legally possess, any cannabis products, lower -potency hemp edibles, or <br />244.27 hemp -derived consumer products, or using any cannabinoid product or hemp -derived <br />244.28 consumer product, other than consumption by combustion or vaporization of the product <br />244.29 and inhalation of smoke, aerosol, or vapor from the product. <br />Article 6 Sec. 39. 244 <br />
