[504B.1715] COVENANTS; SOBER HOMES. <br />245.2 A sober housing program for people with substance use disorders may prohibit people <br />245.3 in the program from the possession and use of cannabis flower, cannabis products, <br />245.4 lower -potency hemp edibles, or hemp -derived consumer products. <br />245.5 Sec. 41. Minnesota Statutes 2022, section 609B.425, subdivision 2, is amended to read: <br />245.6 Subd. 2. Benefit eligibility. (a) A person convicted of a drug offense after July 1, 1997, <br />245.E except for convictions related to cannabis, marijuana, or tetrahydrocannabinols, is ineligible <br />245.8 for general assistance benefits and Supplemental Security Income under chapter 256D until: <br />245.9 (1) five years after completing the terms of a court -ordered sentence; or <br />245.10 (2) unless the person is participating in a drug treatment program, has successfully <br />245.11 completed a program, or has been determined not to be in need of a drug treatment program. <br />245.12 (b) A person who becomes eligible for assistance under chapter 256D is subject to <br />245.13 random drug testing and shall lose eligibility for benefits for five years beginning the month <br />245.14 following: <br />245.15 (1) any positive test for an illegal controlled substance under chapter 152; or <br />245.16 (2) discharge of sentence for conviction of another drug felony. <br />245.17 (c) Parole violators and fleeing felons are ineligible for benefits and persons fraudulently <br />245.18 misrepresenting eligibility are also ineligible to receive benefits for ten years. <br />245.19 Sec. 42. Minnesota Statutes 2022, section 609B.435, subdivision 2, is amended to read: <br />245.20 Subd. 2. Drug offenders; random testing; sanctions. A person who is an applicant for <br />245.21 benefits from the Minnesota family investment program or MFIP, the vehicle for temporary <br />245.22 assistance for needy families or TANF, and who has been convicted of a drug offense, <br />245.23 except for convictions related to cannabis, marijuana, or tetrahydrocannabinols, shall be <br />245.24 subject to certain conditions, including random drug testing, in order to receive MFIP <br />245.25 benefits. Following any positive test for a controlled substance under chapter 152, the <br />245.26 convicted applicant or participant is subject to the following sanctions: <br />245.27 (1) a first time drug test failure results in a reduction of benefits in an amount equal to <br />245.28 30 percent of the MFIP standard of need; and <br />245.29 (2) a second time drug test failure results in permanent disqualification from receiving <br />245.30 MFIP assistance. <br />Article 6 Sec. 42. 245 <br />
