HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />254.1 (b) Minnesota Statutes 2022, section 152.027, subdivisions 3 and 4, are repealed. <br />254.2 (c) Minnesota Statutes 2022, section 152.21, is repealed. <br />254.3 EFFECTIVE DATE. Paragraph (a) is effective January 1, 2024. Paragraph (b) is <br />254.4 effective August 1, 2023. Paragraph (c) is effective July 1, 2023. <br />254.5 <br />ARTICLE 7 <br />254.6 TEMPORARY REGULATION OF CERTAIN PRODUCTS <br />254.7 Section 1. Minnesota Statutes 2022, section 34A.01, subdivision 4, is amended to read: <br />254.8 Subd. 4. Food. "Food" means every ingredient used for, entering into the consumption <br />254.9 of, or used or intended for use in the preparation of food, drink, confectionery, or condiment <br />254.10 for humans or other animals, whether simple, mixed, or compound; and articles used as <br />254.11 components of these ingredients, except that edible cannabinoid products, as defined in <br />254.12 section 151.72, subdivision 1, paragraph {e}_f , are not food. <br />254.13 EFFECTIVE DATE. This section is effective the day following final enactment. <br />254.14 Sec. 2. Minnesota Statutes 2022, section 151.72, is amended to read: <br />254.15 151.72 SALE OF CERTAIN CANNABINOID PRODUCTS. <br />254.16 Subdivision 1. Definitions. (a) For the purposes of this section, the following terms have <br />254.17 the meanings given. <br />254.18 (a) "Artificially derived cannabinoid" means a cannabinoid extracted from a hemp plant <br />254.19 or hemp plant parts whose chemical makeup is changed after extraction to create a different <br />254.20 cannabinoid or other chemical compound by applying a catalyst other than heat or light. <br />254.21 Artificially derived cannabinoid includes but is not limited to any tetrahydrocannabinol <br />254.22 created from cannabidiol. <br />254.23 (b) "Batch" means a specific quantity of a specific product containing cannabinoids <br />254.24 derived from hemp, including an edible cannabinoid product, that is manufactured at the <br />254.25 same time and using the same methods, equipment, and ingredients that is uniform and <br />254.26 intended to meet specifications for identity, strength, purity, and composition, and that is <br />254.27 manufactured, packaged, and labeled according to a single batch production record executed <br />254.28 and documented during the same cycle of manufacture and produced by a continuous <br />254.29 process. <br />254.30 09�}-Uc "Certified hemp" means hemp plants that have been tested and found to meet the <br />254.31 requirements of chapter 18K and the rules adopted thereunder. <br />Article 7 Sec. 2. 254 <br />
