HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />261.1 (6) it contains more than 0.3 percent of any tetrahydrocannabinol or, if the product is <br />261.2 an edible cannabinoid product, an amount of tetrahydrocannabinol that exceeds the limits <br />261.3 established in subdivision 5a, paragraph (f); or <br />261.4 (7) it contains more than trace amounts of mold, residual solvents, pesticides, fertilizers, <br />261.5 or heavy metals. <br />261.6 (b) A product regulated under this section shall be considered a <br />261.7 noncompliant product if the product's labeling is false or misleading in any manner or in <br />261.8 violation of the requirements of this section. <br />261.9 (c) The ;Ilkly <br />261.10 <br />261.11 commissioner may assume that any product regulated under <br />261.12 this section that is present in the state, other than a product lawfully possessed for personal <br />261.13 use, has been manufactured, imported, distributed, or stored with the intent to be offered <br />261.14 for sale in this state if a product of the same type and brand was sold in the state on or after <br />261.15 July 1, 2023, or if the product is in the possession of a person who has sold any product in <br />261.16 violation of this section. <br />261.17 (d) The commissioner may enforce this section, including enforcement against a <br />261.18 manufacturer or distributor of a product regulated under this section, under sections 144.989 <br />261.19 to 144.993. <br />261.20 (e) The commissioner may enter into an interagency agreement with the Office of <br />261.21 Cannabis Management to perform inspections and take other enforcement actions on behalf <br />261.22 of the commissioner. <br />261.23 Subd. 7. Violations; criminal penalties. (a) Notwithstanding section 144.99, subdivision <br />261.24 11, a person who does any of the following regarding a product regulated under this section <br />261.25 is guilty of a gross misdemeanor and may be sentenced to imprisonment for not more than <br />261.26 one year or to payment of a fine of not more than $3,000, or both: <br />261.27 (1) knowingly alters or otherwise falsifies testing results; <br />261.28 (2) intentionally alters or falsifies any information required to be included on the label <br />261.29 of an edible cannabinoid product; or <br />261.30 (3) intentionallv makes a false material statement to the commissioner. <br />261.31 (b) Notwithstanding section 144.99, subdivision 11, a person who does any of the <br />261.32 following on the premises of a registered retailer or another business that sells retail goods <br />Article 7 Sec. 2. 261 <br />
