HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />260.1 Subd. 5c. Age verification. (a) Prior to initiating a sale of an edible cannabinoid product, <br />260.2 an employee of a retailer must verify that the customer is at least 21 years of age. <br />260.3 (b) Proof of age may be established only by one of the following: <br />260.4 (1) a valid driver's license or identification card issued by Minnesota, another state, or <br />260.5 a province of Canada and including the photograph and date of birth of the licensed person; <br />260.6 (2) a valid Tribal identification card as defined in section 171.072, paragraph (b); <br />260.7 (3) a valid passport issued by the United States; <br />260.8 (4) a valid instructional permit issued under section 171.05 to a person of legal age to <br />260.9 purchase edible cannabinoid products, which includes a photograph and the date of birth <br />260.10 of the person issued the permit; or <br />260.11 (5) in the case of a foreign national, by a valid passport. <br />260.12 (c) A registered retailer may seize a form of identification listed under baraarabh (b) if <br />260.13 the registered retailer has reasonable grounds to believe that the form of identification has <br />260.14 been altered or falsified or is being used to violate any law. A registered retailer that seizes <br />260.15 a form of identification as authorized under this paragraph must deliver it to a law <br />260.16 enforcement agency within 24 hours of seizing it. <br />260.17 Subd. 6. Noncompliant products; enforcement. (a) A product regulated under this <br />260.18 section, including an edible cannabinoid product, shall be considered <br />260.19 a noncompliant product if the product is offered for sale in this state or if the product is <br />260.20 manufactured, imported, distributed, or stored with the intent to be offered for sale in this <br />260.21 state in violation of any provision of this section, including but not limited to if: <br />260.22 (1) it consists, in whole or in part, of any filthy, putrid, or decomposed substance; <br />260.23 (2) it has been produced, prepared, packed, or held under unsanitary conditions where <br />260.24 it may have been rendered injurious to health, or where it may have been contaminated with <br />260.25 filth; <br />260.26 (3) its container is composed, in whole or in part, of any poisonous or deleterious <br />260.27 substance that may render the contents injurious to health; <br />260.28 (4) it contains any food additives, color additives, or excipients that have been found by <br />260.29 the FDA to be unsafe for human or animal consumption; <br />260.30 (5) it contains an amount or percentage of nonintoxicating cannabinoids that is different <br />260.31 than the amount or percentage stated on the label; <br />Article 7 Sec. 2. 260 <br />
