Adopted 11/10/86 <br />CITY OF WEST ST. PAUL <br />PUBLIC FACILITIES POLICY <br />(Revisions 4/3/89, 12/11/89, 4/23/90, 8/27/90, 11/12/91, 9/28/92, 11/22/93, 1/9/95, 4/10/95, 8/14/95, 11/12/96, <br />12/16/96, 10/27/97, 7/27/98, 8/13/01, 5/13/02, 6/23/03, 7/28/03, 8/8/05) <br />It is the policy of the City of West St. Paul to provide quality streets for the use of all taxpayers. Streets not <br />meeting minimum quality standards by reason of age or damage will be scheduled for resurfacing or replacement <br />(as needed) on an area basis. <br />Within the area or areas designated by Council for a given two year period, all streets needing work will be done, <br />unless the majority of owners on a particular block files written objection with the City Clerk at or before the <br />public hearing regarding the improvement. An annual street maintenance assessment will be levied on all blocks <br />which so decline the resurfacing/replacement program, in order to meet the extraordinary maintenance costs <br />incurred to patch those streets. <br />It shall be City policy to subsidize the resurfacing/replacement program, so that owners shall be assessed a fixed <br />amount per front foot. This amount shall be: $36.70 per front foot for 2006 and later reconstruction work; $12.20 <br />per front foot for 2006 and later mill and overlay work; said amounts to be adjusted by inflation in the future. No <br />subsidy work will be done without such assessment. Assessments will run with terms up to ten (10) years to allow <br />easier repayment. <br />Comer Lot Credit: The Total Assessable Footage (TAF) for a corner lot with both sides abutting work under this <br />program shall be the total length of street frontage minus the lesser of the length of the longest side or 100 feet. <br />Any allowable credit will not be applied until such time that the second side is considered for assessment. A <br />similar credit may be applied to odd -shaped and/or double -frontage lots at the Council's discretion, except that <br />double -frontage residential lots using, or potentially using, the rear street for garage access will be assessed at one- <br />half the current street reconstruction rate for the rear lot width with no other credit allowed. <br />All streets receiving City subsidy money must have, or must have installed, "B" type concrete curb and gutter. <br />Nothing in the foregoing policy shall prevent property owners from petitioning for work bringing their streets to <br />minimum quality standards at their own expense, either outside the areas being currently done, or within those <br />areas to standards different from those used in the subsidy program. <br />Although need will be the primary determining factor in setting the order of the work, another important factor will <br />be citizen support of the program, evidenced by petitions. <br />Any proposed project which, after proper notice and hearing is voted on in the negative, in agreement with the <br />views of the majority of the abutting property owners, may not be again considered for the reconstruction work <br />until such time that all other segments in need of such work have received due consideration. <br />That underground lawn sprinklers and landscaping features which do not interfere with the public use of the street <br />right-of-way may be installed and maintained in said right-of-way at the sole risk and expense of the owner of the <br />adjacent property installing or maintaining the same. <br />It is the responsibility of the owner of the adjacent property to promptly remove or move such sprinklers or <br />landscaping features to facilitate the City's repair of reconstruction of its streets or utilities. <br />The City of West St. Paul shall not be responsible for any damage to or the destruction of sprinklers or landscaping <br />features within the public street right-of-way in its maintenance, repair or reconstruction of the street or any utilities <br />therein. <br />17 <br />
