Councilmember Pearson moved for the adoption of the following findings of fact: <br /> <br />RESOLUTION #06-02-045 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0752 RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR A 195-FOOT SELF- <br />SUPPORTING LATTICE-STYLE COMMUNICATIONS TOWER. <br /> <br /> WHEREAS, Anoka County, hereinafter referred to as "Applicant", has properly applied <br />for a Conditional Use Permit to construct and operate a lattice-style communications tower <br />("Tower") on the property generally located south of Alpine Drive NW and east of Nowthen <br />Boulevard NW and legally described as follows: <br /> <br />Lot 2, Block 1, Holasek's Addition, Anoka County, Minnesota <br /> <br />(the "Subject Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Planning Commission for a public hearing <br />pursuant to Section 9.03.05 of the Ramsey City Code on February 2, 2006, and that said <br />public hearing was properly advertised and that the minutes of said public hearing are <br />hereby incorporated by reference. <br /> <br />That the Subject Property is located in the P-Public/Quasi Public District, is <br />approximately 23 acres in size, and is owned by the City of Ramsey. <br /> <br />That the Applicant is requesting that the City provide an eighty (80) foot by eighty (80) <br />foot portion of land on the Subject Property (Site) to facilitate the construction and <br />operation of the Tower. <br /> <br />That the property to the east and south are zoned R-1 MUSA, the property to the north is <br />zoned R-2 Medium Density Residential, and the property to the west is zoned B-I <br />Business. <br /> <br />That City Code restricts tower heights to 120 feet, 165 feet, and 175 feet in residential, <br />commercial, and industrial districts, respectively, but does not specify a maximum tower <br />height in the Public/Quasi Public district. <br /> <br />That the use of Public/Quasi Public lands is generally most comparable to that of <br />commercial lands. <br /> <br />That City Code states that the City Council may permit a greater tower height if it is <br />demonstrated to their satisfaction that surrounding topography, structures, vegetation or <br />other factors make the height limit for a complying tower impractical. <br /> <br />That City Code requires commercial wireless telecommunication service towers to be of a <br />monopole design unless the City Council determines that an alternative design is <br />preferred in cases where structural or design considerations, neighborhood compatibility, <br />locational availability, or the number of potential co-locations warrants this consideration. <br /> <br /> <br />
