10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />17. <br /> <br />18. <br /> <br />19. <br /> <br />20. <br /> <br />That the Applicant does not conform to City Code's definition of commercial wireless <br />telecommunication services, which are defined as services being marketed to the general <br />public. <br /> <br />That the Applicant is proposing to construct a 195-foot self-supporting lattice-style <br />communications tower with a fenced in 80' x 80' equipment area, which will also contain <br />an equipment shelter that will be 12' x 20'. <br /> <br />That City Code establishes a setback for towers and related equipment buildings in <br />accordance with the established setbacks for the underlying zoning district; however, the <br />Subject Property is zoned Public/Quasi Public for which there are no specific standards. <br /> <br />That City Code requires ground mounted equipment to be screened from view by suitable <br />vegetation, except where a design of non-vegetative screening better reflects and <br />complements the character of the surrounding neighborhood, as determined by City <br />Council. <br /> <br />That the Tower base and equipment building will be completely enclosed with cyclone <br />fencing, which, for security purposes, will also include barbed-wire around the top of the <br />fence that is at least six (6) feet above ground level. <br /> <br />That landscaping, intended to screen the Tower base and equipment building, will be <br />required and said landscaping is subject to City approval. <br /> <br />That the Applicant has stated that there will be no personnel stationed at the site and the <br />base of the Tower will be encompassed by a security fence to prevent unauthorized entry. <br /> <br />That the Applicant has stated that access to the Subject Property will be from a gravel <br />driveway and that no parking will be required because site visits will be infrequent and of <br />limited duration. <br /> <br />That City Code states that no new tower shall be approved unless the City Council finds <br />that the equipment planned for the proposed tower cannot be accommodated on an <br />existing or approved tower or building within a 1-mile radius of the proposed tower for <br />various reasons including insufficient height to reasonably function. <br /> <br />That the Applicant has stated that there are no existing buildings or structures in the 1- <br />mile search area of a sufficient height to accommodate the proposed equipment and <br />provide a strong, seamless signal. <br /> <br />That City Code requires newly constructed towers to accommodate at least two additional <br />users; the Applicant has stated that the Tower design would permit at least two additional <br />users. <br /> <br />That City Code requires a monopole design unless the City Council determines that an <br />alternative design is preferred in cases where structural or design considerations, <br />neighborhood compatibility, locational availability, or the number of potential co- <br />locations warrants this consideration. <br /> <br />RESOLUTION #06-02-045 <br /> Page 2 of 3 <br /> <br /> <br />
