CASE #5:

Tonto Street N.W. which after checking I find is correct. Con-
sequently, we have a situation where we are creating a serious
violation of our own ordinance in regards to our assessment
policy.

Council Action: Your actionwill be to review this case in
accordance with your policy on assessing corner lots. The
amount of money involved here in this case is as follows:
l) At your meeting of October 28, 1980, you reduced his total
assessment from $2,196 to $1,098. The City would pick up
the deleted half unit $1,098 as City sh~re.

2) If you recind your action you will then be assessing him
the full uoit of $2,196.
However, you may want to have him close off the one approachway
to his place. This would be a weak approach to the problem.
In the future we should never act on thirgs at citizens input
of this nature without doing a full review.
FINDING OF FACT REGARDING THE BUILDABILITY OF CERTAIN LOTS CON~

TAINED IN THE FOLLOWING CONSTRUCTION PROJECTS;
Council at their meeting of October 28, 1980 tabled action on
the following items in enclosure (D-2 case #4 of the agenda.
Council also requested its mender to physically review the be-
low items before the next meeting.

a) ULt. Ronald Kramer 'Plat 89206 Parcel 3685 (_Construction
Project #80-6) regarding the buildability of the above
parcel of land.

b) Ma". Harold Hanson Plat 89201 Parcel 1260 (_Construction
Project #80-12) regarding the buildability of a lot,

Comments: The Council should review each of the finding of
fact very carefully on each of the above cases. At the meet-
lng of October 28, 1980, it was stated that aesthetic were
a problem in regards to locating a dwelling on the parcel of
land in question due to the power line in Kramer's case. I
commented that if that was the case then the Hanson's would
have the same problem. Further, I stated that if the power
line was the sole reason for deleting the assessment in Kramer's
case then other homes as we cited in the finding of fact had
the same problem and they should be given a break in their
valuation.

Council Action: Will be to act on the finding of fact and then
if you approve of the deletion of the assessment adopt the appro-
priate resolution.
