1) That the applicant has properly applied for a conditional use permit <br />to operate and ~aintain a nursery. <br />2) That the applicant appeared before the Planning and Zoning Commission <br />for a public hearing pursuant to City Zoning Ordinance on October 7, 1980. <br />That the public hearing was properly advertized and that the minutes of <br />said public hearing are hereby incorporated by reference. <br />3) That the standards for consideration are as follows: <br /> a) The property is zoned R-1 aud this is not a permitted use. <br /> b) The adjoirdng properties are R-1 on parcels of varying sizes. <br /> c) The closest similar use is within a distance of approxi- <br /> mately one (1) mile. <br /> d) There should be no adverse effect to traffic flows in the <br /> e) Properly maintained, the nursery should not adversely <br /> effect other residences in the area. <br /> <br /> 4) That the criteria for approval/disapproval are as follows: <br /> a) That the establishments maintenance and operation will not <br /> be detrimental to or endauger the public health, safety and <br /> general welfare and is not contrary to established standards, <br /> regulations or ordinauces of other governmental agencies. <br /> b) That the site improvements, as indicated, as a part of the <br /> applicants request, are so designed and constructed that <br /> they will not be unsightly, undesirable or obnoxious in <br /> appearance and that it will not hinder the orderly and <br /> harmonious development of the City and the use of the dis- <br /> trict wherein proposed. <br /> c) That the use will not be substantially injurious to the per- <br /> mitted uses nor unduly restrict the enjoyment of other prop- <br /> erty in the immediate vicinity nor substantially diminish <br /> and impair property values within the area. <br /> d) That the establiskment of the use will not impede the orderly <br /> and normal development and improvement of the surrounding <br /> property for uses permitted in the zoning district. <br /> e) That adequate water supply sewage disposal facilities are pro- <br /> vided and in accordance with applicable standards. <br /> f) That adequate access roads, on-site parking, on-site loading <br /> and unloading berths and drainage have been or will be pro- <br /> vided. <br /> g) That adeaute measures have been taken to provide ingress and <br /> egress so designed as to minimize traffic congestions on <br /> public roads. <br /> h) That the use will conform to all applicable regulations of the <br /> of the district wherein proposed. <br /> <br /> <br />
