LETTERS AND CON~UNICATIONS Council received and reviewed a letter dated November 7, 1980 addressed to Governor Quie from Ed Fields regarding the DNR water classification. STAFF REPORTS The reports were received and no actions were taken regarding the same. OLD BUSINESS DRAINAGE PROBL~Ii$ Mr. Mason was present concerning his drainage problem. The City Attorney stated that the drainage laws are such that if the City increases the run off flow or the speed of the run off by blacktopping streets, the City then assumes the responsibility to properly dispose of this run off by the use of easements. City Administrator Schnelle described the problem and report that Mr. Mevissen made relating to 163rd and Olivine, which report is dated November 5, 1980. City Engineer Raatikka said the drainage should be directed north. There was discussion between Council and Mr. Mason regarding a solution to the problem. Mr. Mason was advised that the City would be watching the problem. Mr. Mason asked if fill could be provided to redirect the flow. The fill would be needed in his front yard. He said it would take 600 to 700 cubic yards. This would block the drainage from other homes, which is the run off source. Mr. Mason wants to have his area higher than five feet by approximately~ one foot. His main goal is to keep the water away from the tennis court. Mayor Gamec said he feels_if the ~culverZ is kept clean, this would avoid - the problem. He also said%hat bringing in fill Couldbe too ~ostly~ be- cause of other similar problems in the City. Councilman Reimann agreed. Councilman Cox said perhaps the blacktop could be bermed-enough to keep the water out of Mr. Mason's tennis court. City Adm~uistrator Schnelle said we should have a policy on ~this type of issue-and a special meeting should be set up to address these problems. Mayor Gamec said we will continue to have these problems until storm sewer ~ is put in. Councilman Mickelson said every-problem is different and we can't have a uniform policy. Councilman Mickelson also said we didn'i get a feasibility report on drainage when we blacktopped streets and perhaps we should have. City Attorney Goodrich advised that where the potential of flooding of a home or damaging a drainfield is present, the City should take specific action. Motion by Councilman Reimann ~ud seconded by Councilman Cox to table Mr. Mason's problem in order for Merle to make a visual inspection and report back to the Council. Motion carried.
