MOTION <br /> That based on the above Findings of Fact the-Planning Commission <br />recommends to the City Council that the City enter into a conditional use <br />permit agreement between Mrs. Nugent and the City and that when said <br />agreement is executed by all parties, a conditional use permit be issued <br />to the applicant to conform with the agreement, and that said conditional <br />use permit agreement contain the following conditions: <br /> 1. The applicant supply a drawing of where the animals will be <br /> located in the garden and cement slab, including measurements. <br /> ber of animals not to exceed 50 contingent upon the accep- <br /> 2. Num ~ ~- ~ ~hat amount of cattle as determined <br /> tability of that parcel uu ~,~ ~ <br /> by the PCA permit. <br /> 3. Applicant must obtain a PCA feedlot permit and comply with the <br /> conditions set forth therein. <br /> 4. The present pig operation to be phased out by May 1, 1981 after <br /> which time no pigs will be permitted on any of the subject premises. <br /> 5. The existing corrugated steel fence will be removed by June 1, <br /> 1981. <br /> 6. The maximum number of permitted cows contained on the 4.9 acre <br /> site will be there for an approximate 2-month_period each'spring. In no <br /> event shall the cattle be on the 4.9 acre site later than May 15th of <br /> each year, with the exception of one milk cow which may be maintained <br /> on this site during the entire year. If unusual seasonal circumstances <br /> require, the applicant may request of the City Council permission to <br /> keep the cattle on the 4.9 acre site after the May 15th deadline. <br /> 7. There will be no manure spreading in the Ford Brook flood plain <br /> or west of said flood plain. <br /> 8. The applicant will provide and implement an insect and rodent <br /> prevention plan. <br /> 9. There will be no manure stock piling on the 4.9 acre site and <br /> the manure will be cleaned so as not to cause a nuisance and shall be <br /> cleaned at a minimum of at least once every two weeks. <br /> 10. The conditional use permit shall be issued only to the present <br /> applicant and will not run with the land. <br /> 11. This permit where applicable shall apply to the Dill property <br /> such that the applicant can maintain cows on said property. <br /> Motion carried, voting yes: Ron West, Kathy Schneider, Harry Ellis, <br /> Kenneth Peterson, Art Dunn and Benjamin Deemer. voting no: None <br /> <br /> <br />
