Entitlement Period Twelve <br /> <br />October l, 1980 - September 30, 1981 <br />STATEMENT OF ASSURANCES <br /> <br />The recipient government assures that it will: <br /> (1) Establish a trust fund and deposit all revenue sharing funds received <br /> in that trust fund, according to regulations prescribed by the office of <br /> Revenue Sharing. <br /> (2) Use revenue sharing funds within a reasonable time (two years from the <br /> end of each entitlement period) according to regulations prescribed by the <br /> Office of Revenue Sharing. <br /> <br /> (8) Not use entitlement funds for lobbying purposes. <br /> (4) Provide for the expenditure of revenue sharing funds in accordance with <br /> the laws and procedures applicable to the expenditure of its own revenues. <br /> (5) Use fiscal accounting and audit pro~edu~es a~ specified by the office'. <br /> of Revenue Sharing; provide access to and the right to examine books, <br /> documents, papers or records for purposes of reviewing compliance with this <br /> Act; and make such reports as the Director may require. <br /> · (6) Comply with the prevailing wage provisions of the Davis-Bacon Act on <br /> any construction project costing in excess of $2,000 when 25 percent or more <br /> of the costs of such project are paid with revenue sharing funds. <br /> (7) Pay individuals employed in jobs financed in whole or .in part with' <br /> revenue sharing funds not less than the prevailing rates of pay for persons <br /> employed by it in similar public occupations. This provision does not apply <br /> to an employee or employees in any program category who are being paid in <br /> whole or in part with general revenue sharing funds unless 25 percent or more <br /> of the total wages paid to all employees in that category are paid from <br /> revenue sharing funds. <br /> (8) In case of the governing body of an_ Indian tribe Or Alaskan Native <br /> village, spend revenue sharing funds for the-benefit of.members of the tribe <br /> or village residing in the county-area or Census District from which its <br /> revenue sharing funds were allocated. <br /> (9) Not exclude from participation in, deny the benefits of, or subject to <br /> discrimination under any program or activity, any person in the U.S. on the <br /> grounds of race, color, national origin, or sex. Not discriminate on the <br /> basis of age under the Age Di'scrimination Act of 1975, or with respect to an <br /> otherwise qualified handicapped individual as provided in Section 504 of the <br /> Rehabilitation Act of 1973, or religion except that any exemption from such <br /> prohibition against discrimination on the basis of religion as provided in <br /> the civil Rights Act of 1964, or Title VII of the Act of April 11, 1968, <br /> shall also apply. <br /> (10) In the event a Federal or State court or Federal administrative law <br /> judge makes a holding, as defined in Section 51.67 of the regulations, <br /> against the recipient government, provide a copy of the holding to the <br /> Director of the Office of Revenue Sharing within 10 days of receipt of such a <br /> holding by the recipient government. <br /> The recipient government assures the Director of the Office of Revenue <br /> Sharing that with respect to payment received under the Act, the mandatory <br /> requirements of the State and Local Fiscal Assistance Act of 1972 as amended and <br /> of the regulations will be complied with by this government. <br /> The recipient government further assures the Director of the office of <br /> Revenue Sharing that the public hearing and public participation requirements, <br /> the independent audit requirements and any other provisions of the Act will be <br /> complied with by this government. <br /> The recipient government understands that the acceptance of the Assurance <br /> Signature Card by the Director of the Office of Revenue Sharing does not prevent <br /> the Director from holding a recipient government responsible for noncompliance <br /> with the Act and the regulations. <br /> <br /> <br />
