ENTERING THE <br />METROPOLITAN AGRICULTURAL PRESERVES PROGRAM <br /> <br /> DIRECTIONS FOR CO~LETING <br />THE THREE-PART APPLICATION FORM <br />{OCTOBER, 1980) <br /> <br /> ELIGIBILITY OF YOUR LAND <br />The eligibility of your land must be determined even before you can sign up <br />for the Metropolitan Agricultural preserves Program. your local "Authority" <br />has a primary role in this procedure. The Authority is the unit of government <br />exercising planning and zoning authority in your ar~a. If your land lies <br />within municipal boundaries, the Authority is always the city. If your land <br />iS in a township, the Authority could be either the county or the township. <br />Your local Authority must have an adopted plan that the land will be useO for <br />long-term agriculture (eight or more years), must have a zoning ordinance <br />specifying a density of not more than one residential unit per quarter/quarter <br />section (one per 40), and must certify these actions by formal resolution. <br /> In addition to this role for the local Authority in determining eligibility, <br /> there are certain acreage requirements for your land to be put into <br /> agricultural preserves. It must consist of: <br /> <br /> a. at least 40 acres, <br /> b. parcels of at least lO acres each, to achieve a minimum of 40 acres, <br /> and be farmed as a unit, <br /> c. 35 acres (if a single quarter/quarter parcel) if due to a public <br /> right-of-way or survey system perturbation, or <br /> d. 20 acres which meet the conditions of Minn. Stat. 473H.03, Sub. 4. <br />When your land meets the acreage requirement and is declared eligible by your <br />local Authority, the Authority will fill out an affidavit attesting to its <br />eligibility as part of the application process. (See section on Attachment B, <br />below.) <br /> <br /> THE APPLICATION PROCESS AND FORM <br /> <br />The application form consists of three parts: <br /> <br /> 1. The Restrictive Covenant {AG-00869-01), <br /> 2. ,'Attachment A" - ,,Application for Initiating Placement of Land into a <br /> Metropolitan Agricultural Preserve" (AG-O0870-O1), and <br /> 3. "Attachment B" - ,'Affidavit of Authority (AG-O0871-O1). <br />All three parts of the application must be correctly completed before the <br />preserve can be established. <br /> <br />-3- <br /> <br /> <br />
