Before Completing the Application <br /> <br /> 1. It is recommended that you confer with your attorney about your <br /> decision to enter the Metropolitan Agricultural Preserves Program. <br /> <br /> 2. Get an accurate le~ description of all the land you intend to have <br /> designated as ag~cultural preserves. You can probably use the <br /> description in your deed for this purpose. <br /> 3. Determine who must sign the Restrictive Covenant and Attachment A. <br /> <br /> a. If the land is owned by a single, unmarried individual, only the <br /> individual must sign. <br /> b. If the landowner is a Vendee on a Contract for Deed, the Vendor(s) <br /> must sign as well as the Vendee(s). The Vendor is the person who <br /> sold the land, and the Vendee is the person who bought the land <br /> and is making payments. <br /> c. If the land is owned in joint tenancy or "in common" with others, <br /> all of the'Owners must sign. <br /> d. Your attorney should verify whether additional signatures are <br /> ne~e~. For examp-l-~, is thi~ily Farm Corporation? Are <br /> there'any guardians or conservators? <br /> e. If the land is owned by a married couple, both the husband and <br /> wife must sign. <br /> <br /> 4. If your land is registered Torrens property, have your Owner's <br /> Duplicate Certificate of Title with you, ready to present to the <br /> Authority with your application. <br /> <br /> 5. Find out from your Authority the amount of the application fee. The <br /> law states that local Authorities may charge up to $50 for <br /> administrative costs. <br /> <br />Completin9 the Application <br />Step One: Complete Attachment B, Affidavit of Authority (AG-O0871-O1): <br /> <br /> -1. You must type in the compiete legal description of all the <br /> property you intend to include in the agricultural preserve in <br /> Item {3) of Attachment B. <br /> <br /> 2. Take Attachment B to your local Authority and have the <br /> representative complete the rest of the items on the <br /> affidavit. <br /> <br />Step Two: <br /> <br />Item (1) <br /> <br />Complete Attachment A, Application for Initiating Placement of <br />Land into a Metropolitan Agricultural Preserve (AG-O0870-O1): <br />You must complete items (1) through {8) of this part. <br />Type or print the name {or names) of the Owner, or if a Contract <br />for Deed, the Vendee's name and address. <br /> <br />-4- <br /> <br /> <br />
