Step One: Step Two: Step Three: 3tep Four:' before land The local government must have a comprehensive plan that has been reviewed by the Metropolitan Council under the Metropolitan Land Planning Act. Within the comprehensive plan, an area or areas must be planned for ions-term asricultural use. The Act implies that this would be eight or more years. VOLUNTARY PARTICIPATION Once the four steps have been completed, a landowner may enter the program voluntarily. The local government has no power to compel an owner to participate. APPLICATION AND SIGN U~ The landowner applies for the agricultural preserve designation on a special form provided by the state commissioner of asriculture. This application form is extremely important. As a sins1, instru- ment it constitutes formal application and describes the property. It includes local affidavit of elisibility, and notice to several agencies, includins the resister of deeds and the assessor. Most important, it establishes the restrictive covenant for the land with limitation and benefits. 2
