The landowner will be responsible for filling out the form. <br />The form is then submitted to the local government. The local <br />government has no discretionary prerogative at this point. The <br />decision of eligibility has been made through planning and zoning <br />and finalized through the certification process. The only issues <br />before the local government at this point are correctness of the <br />application, whether or not the land applied for is certified and <br />whether the minimum acreage requirement is met. <br /> <br />NOTIFICATION <br />The local government is responsible for notifying the <br />people or agencies within five days: <br /> <br />following <br /> <br /> · County recorder, <br /> .e County auditor, <br /> · County assessor, <br /> · County soil and water conservation district, and the <br /> · Metropolitan Council <br />The application is designed to assist with the notification <br />responsibility. <br /> <br />ELIGIBILIT~ <br />Under the Act,'the land qualifies, not the owner. The only other <br />requirement is to have the minimum acreage. Once the land is certi- <br />fied eligible, any landowner who is a resident of the U.~., or any <br />family farm corporation with the minimum number of acres, may apply. <br /> <br />MINIMUM ACREAG~ <br /> <br />The minimum acreage is ~0 acres, <br />whereby this can be reduced: <br /> <br />but there are certain exceptions <br /> <br />1. Noncontiguous parcels at least l0 acres in size and aggregating <br /> ~0 or more acres may he eligible if~they.are farmed together as <br /> a unit. <br /> This provision was included especially for peatland farms where <br /> small parcels are'common. The local government is presumed to <br /> retain final Judgment on this matter. <br /> <br />2. The minimum acreage requirement may be reduced to 35 acres if <br /> the land is a single quarter/quarter Section and the amount le~s <br /> than ~0 acres is due to a public road right-of-way or a <br /> perturbation in the rectangular survey system leaving a <br /> quarter/quarter of less than ~0 acres. <br /> <br />3. The minimum acreage can be reduced to 20 acres if it is adjacent <br /> to eligible land on not less than two sides and the following <br /> conditions are met: <br /> <br /> <br />
