a <br /> <br />e <br /> <br />The land area predominantly comprises Class I, II, III, or <br />irrigated Class IV land according to the Land Capability <br />Classification Systems of the Soil Conservation Service and <br /> <br />the county soil survey; <br /> <br />The local government Considers the land <br />part of the agricultural region; and <br /> <br />to be an essential <br /> <br /> The parcel was a parcel of record prior to January 1, 1980; <br /> or, the land was an agricultural preserve prior to becoming <br /> a separate parcel of at least 20 acres. <br />Contiguous long-term agricultural land meeting the total acreage <br />requirements, but located in two or more separate local . <br />government Jurisdictions so that the minimum acreage requirement <br />is not met in one or more Jurisdictions is eligible through <br />joint resolution of the affected local governments. <br /> <br />DURATION <br />An agricultural preserve continues indefinitely until either the <br />owner or the local government initiates expiration, after which time <br />the duration is at least eight more years. There is no set review <br />period. Review is entirely up to the owner or local government <br />through the planning and zoning process. <br /> <br />EXPIRATIO~ <br />Either the owner or the local government may initiate the eight-year <br />expiration period. Eight years from date of notice the preserve <br />expires. There are no penalties, repayments, or punitive actions <br />for expiration. . <br />The landowner may initiate expiration at any time by notifying the <br />local government on a special form provided by the state commis- <br />sioner of.agriculture. .. <br />'Or, the local government may initiate expiration by changing the <br />planning and zoning for the land so that the land is no longer <br />planned for long-term agriculture and no longer zoned "one per ~0.w <br />The zoning must be changed to allow more than one unit per 40 <br />acres. Then the local government must decertify the eligibility by <br />formal resolution and publish that decertifioation in a local <br />newspaper. . · <br /> After these steps have been taken, the local government issues <br /> notice of expiration to th9 landowner. The preserve or portion of <br /> it expires exactly eight years from the date of notice. <br /> EARLT T~RHINATION <br /> In the event of a public emergency, determined by the governor, the <br /> landowner or the local government may petition the governor for <br /> early termination. <br /> <br /> <br />
