SPECIAL ASSESSMENTS <br /> <br />Agricultural preserve <br />sewer projects. <br /> <br />land cannot be assessed <br /> <br />for public water or <br /> <br />NORMAL FARM PRACTICE~ , <br />The law prohibits local government from enacting ordinances that <br />unreasonably restrict or regulate normal farm practices, unless the <br />restriction directly improves the public health and safety. This <br />section of ~he law applies to "the operation of farm vehicles and <br />machinery in the plantinE, maintenance and harvesting of crops and <br />in the care and feedinE of farm animals, the type of farming, and <br />the design of farm structures, exclusive of residences-t <br /> <br />CONSERVATION <br /> <br />Usually landowners will farm the land without causin~ undue ero- <br />sion. In the event of a severe erosion problem, however, the law <br />provides a process for review and remedy. If a written complaint is <br />received, the local government confers with the county soil and <br />water conservation district. If the local ~overnment then feels <br />that there is a problem, it seeks corrective action from the owner. <br />If the owner fails to comply within one year, the local government <br />may take the owner to court and seek a fine of up to $1,000. Costs <br />incurred by the local government in enforcin~ this law may be <br />assessed to the property. <br /> <br />LAND USE <br />Owners must keep their preserve land in farm use. The lo~a1' <br />government is responsible for enforoin~ this requirement. Most <br />important is that residential density on any preserve must not <br />exceed one unit per ~0 acres. The location of a residential <br />structure is up to the local ~overnment through its zonin~ regula- <br />tions. The law permits clusterin~ as lom~ as the density in the <br />preserve does not exceed one per ~0. <br /> <br />OTHER PROVISION~ <br />There are'many other aspects of this law that may not directly <br />affect the local sovernment.
