MODEL A GRICUL TURE PRESER VA T/ON ORDINANCE* <br /> <br /> ORDINANCE NO. <br /> <br /> ., MINNESOTA <br /> AGRICULTURE PRESERVATION ORDINANCE <br /> <br />An ordinance promoting the health, safety and gert- 1 <br />eral welfare of the citizens of <br />Minnesota, by amending the zoning ordinance, by <br />repealing sections 2 thereof and <br /> <br />adopting new sections pertaining to agriculture <br />districts. <br /> <br />I, LEGISLATIVE INTENT AND FINDINGS OF FACT3 <br />The governing body does hereby find that land lying within the boundaries of the 1 <br />for which the logical and proper use is agriculture is threatened by rapid expanding growth and <br />urban development. The governing body further finds that urban development must be accom- <br />modated in a logical and orderly fashion in order to minimize the conflicts between urban and <br />agricultural uses. The governing body further finds that the development and urbanization of <br />high-quality agricultural land is detrimental to the health and safety of the citizens of <br /> 1, Minnesota. <br /> <br />It is the purpose of this ordinance to identify and classify such lands lying within the boundaries <br />of 1, Minnesota for which the logical and proper long-term use is agriculture and <br />to preserve and protect said agricultural land from unnecessary encroachment by non-agricultural- <br />uses. <br /> <br />The governing body further finds that urban development must be accommodated. The <br />designation of those lands and areas that are, or will in the near future, become suitable for <br />urbanization will direct urban growth within the 1 to the most appropriate <br /> <br />areas and away from prime agricultural land. It is the purpose of this ordinance to identify <br />land currently in agricultural use which is suited to urban uses and to preserve it in agricultural <br />use until such time as streets, sewers, water supply and other community facilities, utilities and <br />services am provided or scheduled so as to ensure orderly and beneficial conversion of such lands <br />to non-agricultural use and to prevent their premature conversion. <br /> <br />II. DEFINITIONS4 <br /> <br />1. Accessory Structure: A structure whose use is associated with but incidental to the main <br /> use of the parcel on which it is situated. <br /> <br />3. <br /> <br />Building: Any structure used for the shelter of persons, animals or property of ~ny kind. <br /> <br />Capital Improvement Program: An itemized program for a five year prospective period, <br />subject to at least biennial review, setting forth the schedule, timing and details of specific <br />contemplated public improvements by year, together with their estimated cost, the need <br />for each improvement, financial sources, and the financial impact that the improvements <br />will have on the local governmental unit. <br /> <br /> <br />
