o <br /> <br />10. <br /> <br />11. <br /> <br />agriculture areas should generally be included in the agriculture preservation district (AgP-1). <br />The AgP-2 district is intended for use in those agricultural areas which will become <br />urbanized in the immediately foreseeable future as urban facilities become available. It <br />may be that a local governmental unit would wish to establish more or fewer districts in <br />order to better tailor its ordinances to the local situation. It is also possible that a local <br />unit of government may want to apply a given district to more than one area of land. This <br />is legally permissible, however, agricultural districts, like all other zoning districts, must be <br />designated on the zoning map. <br /> <br />See comment number 2. If sections of an existing zoning ordinance are to be repealed, <br />this section should be included. The repealed sections should be referenced by section <br />number, ordinance number, and the date of adoption. <br /> <br />The AgP-1 Agriculture Preservation District is, with minor exceptions, an excluslve <br />agricultural use district. Agricultural uses and structures are permitted by right. Residential <br />uses are limited to the farm dwelling unit and one non-farm dwelling unit for each quarter- <br />quarter section (40 acres more or less} which does not already contain a dwelling unit. <br />However, the required lot size for a residential dwelling unit is one acre. In the AgP-1 <br />district, development is restricted by a density factor rather than by lot size. After the <br />non-farm dwelling unit has been built, thirty-nine acres still remain in agricultural use <br />through the use of density rather than large lot zoning, <br /> <br />The terms "local road", "collector road" and "minor arterial" are commonly used terms <br />in most county thoroughfare plans. Before adopting this ordinance, you will want to <br />check to make sure that these are the terms used by your county. Should your county use <br />other terms in its thoroughfare plan, those terms should be substituted here. <br /> <br />Local governmental units treat applications for conditional use permits in various ways. <br />The body given responsibility for issuing conditional use permits in your local governmental. - <br />unit should be inserted in this blank. <br /> <br />Home occupation is a term that is commonly defined in most zoning ordinances. For that <br />reason, it has not been defined in this ordinance. If the local governmental unit's <br />existing zoning ordinance does not include a definition of home occupations, the term <br />should be defined as the local government sees fit. <br /> <br />Several uses are permitted in the agriculture preservation district by conditional use permit. <br />If the local governmental unit has an existing zoning ordinance, it probably already has <br />standards governing the granting of conditional use permits. The more specific the <br />standards are, the better the process works. Those standards are referenced by section and <br />ordinance number in this section. If the local governmental unit does not already have <br />standards for the granting of conditional use permits, the following additional specific <br />concerns should be addressed in this ordinance: <br /> <br />Ingress and egress to the property and proposed structures thereon with particular <br />reference to automotive and pedestrian safety and convenience, traffic flow and <br />control, access in conformance with the county thoroughfare plan. <br /> <br />Offstreet parking and loading areas where required or necessary with particular <br />reference to the items in a above and the effects of noise, glare, odor and conges- <br />tion on adjoining property and properties generally in the district. <br /> <br />Refuse and sanitary service areas, with particular reference to areas specified in <br />items a and b above. <br /> <br />47 <br /> <br /> <br />
