The draft is intended to serve as a policy development <br /> aid for local governments, and ma,/differ in Some respects from the model ordinance <br /> formally approved by the Council later in 1976. <br /> <br /> FOOTNOTES TO AGRICULTURE PRESERVATION ORDINANCE <br /> 1. Since this is a model ordinance, the name of the adopting local governmental unit could <br /> not be inserted. Fill in this blank with the name of the government adopting the <br /> ordinance, i.e. Kalamazoo County, Anderson Township. <br /> <br /> 2. Many local governmental units already have ordinances that establish an agricultural <br /> · district. This section sets forth the findings of fact and logic that led to the adoption of this <br /> agriculture preservation ordinance. Courts traditionally give great deference to the <br /> legislative findings and conclusions of local gOvernmental units. For this reason, setting <br /> forth the logic behind the ordinance can be of assistance should the ordinance be <br /> cha. llenged in court. Finally, setting forth the intent and finding can be of great <br /> assistance to those who must interpret and apply the ordinance and to those landowners <br /> who must Operate under its restrfctions. <br /> <br /> 4. Terms which are essential to the operation of the agriculture preservation ordinance are <br /> defined in this section. The local governmental unit adopting this ordinance should <br /> include these definitions in the definition section of the already existing zoning ordinance. <br /> Some of the terms defined will most likely be defined in the existing zoning ordinance. <br /> When this occurs, it may be possible to combine the two definitions or it may be necessary <br /> to make slight changes. In order to insure continuity, the definitions of Capital <br /> Improvement Program and Comprehensive Sewer Policy Plan incorporate the language of <br /> the Metropolitan Land Planning Act (M.S.A. 473.175). <br /> <br />5. The district boundaries of the agriculture preservation d~strict and the agriculture preservation/ <br /> urban expansion district should be established by following the guidelines set forth in the <br /> Metropolitan Council's agrfculture handbook.
