Consideration of the Eng$neer's Work: The Owner shall gtve thorough consideration to ell reports, sketches, estlmetes, drawings, specifications, proposals, and other documents presen: ted by the Engineer, and shall Inform the Engineer of a11 decto stons within a reasonable time so as not to delay the work of the Engineer. Legal Requirements: The Owner shall hold promptly a11 requtred special meetings, service all required public and private noti- ces, recetve and act upon all protests and fulft11 all require- ments necessary tn the development of the Project, and pay all costs Incidental thereto. Proposals: The Owner shall advertise for Proposals from 81dders, open the Proposals at the appointed time and place and pay ali costs Incidental thereto. Protection of Markers: The Owner shall protect, to the best of his ability, all stakes and other markers set by the Engineer prior to the assumption of such responslblllty by the Contractor. Replaceaent of markers or stakes which have been damaged, moved or removed shall be petd for by the Owner as extra services of the £ngtneer. Standards: The Owner shell furntsh the Engineer wlth a copy of any design and construction standards he shall requtre the Engi- neer to follow tn the preparation of Contract Oocuments for the Project. Owner's Representative: The Ramsey City Admfnlstrator shall act as the Owner's Representative with respect to the work to be performed under this Agreement. He shall have complete authority to transmit Instruction, receive Information, Interpret and deftne Owner's policy and decisions, with respect to the meter- ~. i~ 1als, equipment, elements and systems pertinent to the work '-.~ covered by this Agreement. Owner's Payment to the Englneer, Projects: Generel: The A. (x) (z). (3) Oeflnltlons of Construction Cost of the Project as herein re- ferred to means the total cost of a11 work designed or specified by the Engineer for the Project but does not include any payments to the Engineer or other consultants. Payments Withheld from Contractors: No deduction shall be made from the Engineer's compensation on account of penalty, liqui- dated damages, or other amounts withheld from payments to Con- tractor. Abandoned or Suspended Work: If any work performed by the Engi- neer is abandoned or suspended in whole or in part, the Engineer shall be paid any costs and for services performed on account of it prior to receipt of written notice from the Owner of such abendon~ent or suspension, together with any terminal expenses resulting therefrom, ali as shown at the Engineer's hourly rates times .the multtpller as defined in Sections 6A and 6a.
