In regard to the zoning of farmland for agricultural use and changing
the conditional use permit requirements for livestock, the Council
discussed as follows:
Nayor G~nec state~ the nmjor concern for the citizens is their keeping
~nlmals. The Council will be reasonable in regard to livestock as long as
the nuisance ordinance is respected and the nuisance ordinance will still be
in effect regardless of changing in zoning to agricultural.
Councilmau Cox stated we should delete that portion from the ordinance regarding
the conditional use permit. He doesn't think it appropriate that they need
it due to the state influx of urban density. He doesn't think the farmer should
be penalized.
~ayor Gs_mec suggested no condition use permit necessary at 40 acre parcel or
over. ~yor Gamec asked if citizen's had any questions.
Councilman Sorteberg stated any 40 acre parcel can be on the 8 year program.
Citizen Jerry Peltzer asked what is our ordinance status re animals and acreage.
He is considering the 8 year program.
~ayor Gamec suggested he talk to City Administrator Schnelle and get on the
Planning and Zoning agenda for any zoning changes he wants to make.
Citizen Scroggins inquired about the effect on green acres? ~ayor replied
there would be none.
Councilman Cox stated the ordinance should stay as is for under 20 acres.
~aY°r Gamec stated 40 acres or less would protect more.
~otion by Councilman Cox and seconded by Councilman Sorteberg to direct the staff
to prepare an ordinance changing SllO.90 amending it to eliminate the
requirement of a conditional use permit for animals on any tract of land which is
20 acres in size or larger.
Notion carried. Voting yes: ~ayor Gamec, Councilman Sorteberg, Councilman
Relmsa~n, Councilman Cox and Councilwoman Van Wagner. Voting no: None.
City A~uistrator Schnelle addressed the issue on structure building require-
ments without a building permit. Attorney Goodrich suggested Building.Official
Berg should check the State Bnilding Code regarding farm building requirements.
Citizen ~ked if we are zoned agricultural or as we are, can we go back into animals
if we want to? Nayor Gamec replied yes
Case #3: Petition for Street Improvement; Peltzer Addition:
Bo~o~ound information: .The following background information is hereby
~7~%ed for review in acting on this case as enclosure (D2-c Agenda):
submm
1.
