Councilmember Cox introduced the following resolution and moved for its <br />adoption: <br /> <br /> RESOLUTION #81-11 <br /> <br />RESOLUTION DIRECTING THE CITY ATTORNEY TO pREPARE A DISCRI~INATION SUIT <br />AGAINST THE STATE OF MINNESOTA IN REGARDS TO THE STATE LAW THAT GOVERNS <br />THE DISTRIBUTION OF MUNICIPAL STATE AID STREET APPORTIONN~NT FUNDS <br /> WHEREAS, the City Council of the City of Rsmsey, Anoka <br />County, State of ~innesota, in its review of the 1981 Municipal State <br />Aid Apportionment Book which is published by the Minnesota Transportation <br />Department determined that the State of Minnesota Highway Department used <br />6,517 as a population total for Ramsey's population which population figure <br />is used for computing Municipal State Aid Street (MSA) Apportionment Funds; <br />and <br /> WHEREAS, the City Council, City of Ramsey, Anoka County, <br /> State of Minnesota questioned the ~iinnesota State Transportation Depart- <br /> ment use of the above obsolete population total of 6,517; and <br /> WHEREAS, the State Demographer has established the population <br /> of R~msey at 9,470 using the U.S. Census preliminary field report which <br /> were taken in 1980; and <br /> WHEREAS, a representative of the ~innesota State Transportation <br /> Department informed the City of R~msey that the use of a population of 6,517 <br /> for the City of Rnmsey is in accordance with State Statute 162.09 Subd. 4. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, CITY OF PJg~SEY, ANOKA <br /> COUNTY, STATE OF MINNESOTA, as follows: <br /> 1) The City Council hereby directs that the City Attorney <br /> bring the appropriate lawsUit against the State of Minnesota ordering that <br /> for the purposes of MSA fund distribution, the State use a population figure <br /> which is more reflective and realistic of the current actual population. <br /> 2) The City Council further authorizes the City Attorney to <br /> retain additional legal expertise in the area of constitutional law should <br /> he deem it necessary in order to successfully bring this lawsuit. <br /> The motion for the adoption of the foregoing resolution was duly seconded <br /> by Councilmember Sorteberg and upon vote being taken thereon, the follow- <br /> ing voted in favor thereof: <br /> Mayor Gamec, Councilmembers Sorteberg, Van Wagner, Reimann <br /> mud Cox <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br /> <br />
