City Administrator Ulrich stated he likes LSA's proposal — the terms of their comprehensive <br />approach and their background with the project. <br />Councilmember Elvig stated we could always go with one of the other proposals at a later date if <br />that makes more sense. <br />Mr. Ulrich agreed that doing this in phases allows more flexibility. <br />Councilmember Elvig commented that maybe the City does take more of an active role like that <br />of project manager in phase 2 or 3. <br />Mr. Ulrich stated that this is a huge project for the City as well as staff and we are interested in <br />seeing this through. <br />Councilmember Elvig stated there have been millions of dollars invested in this project thus far. <br />We still have an opportunity sitting here and he thinks we should be more active — protect it and <br />see it grow. <br />Mr. Elvig stated that the initial indication from the City Attorney on whether forfeited taxes are <br />wiped out by foreclosures is that they are. There is $500,000 in back taxes if this property goes <br />into foreclosure. <br />Councilmember Elvig stated that the reverse is true also. Tax forfeiture would wipe out claims <br />and liens on a property; therefore, it would wipe out our development agreement — the City would <br />be out. <br />Community Development Director Miller added but so are they. They would have to buy it back <br />from the County at an auction. <br />Mr. Ulrich stated that if the discussion of the lawsuit is taken back to a closed session of the City <br />Council, it would be August 12, unless we schedule a special meeting. <br />Councilmember Elvig stated that waiting until August 12 would be an issue. <br />Councilmember Strommen agreed and suggested Mr. Ulrich check with City Attorney Goodrich <br />to see if a special meeting could be scheduled instead. <br />Ms. Miller suggested maybe Monday, August 4 — and if not, then from 5:00 to 6:00 on Wednesday, <br />August 6. <br />ADJOURNMENT <br />The Work Session of the Ramsey Town Center City Council Subcommittee was adjourned at 5:20 <br />p.m. <br />Respectfully submitted, <br />Ramsey Town Center City Council Subcommittee Work Session / July 29, 2008 <br />Page 3 of 4 <br />
