CASE <br /> <br /> PUBLIC HEARING <br /> REQUEST FOR VACATION OF EASEMENTS <br />IN THE PROPOSED PLAT OF BROOKFIELD FIRST ADDITION; <br />CASE OF OAKWOOD LAND DEVELOPMENT <br /> By: Amy Geisler, AICP, Associate Planner <br /> <br />Background: <br /> <br />The public hearing to vacate several underlying easements in the proposed plat of Brookfield <br />First Addition was originally advertised and noticed for February 28, 2006. The intent was that <br />the £mal plat request for Brookfield First Addition would be on the same agenda. Due to certain <br />circumstances, it was necessary to remove the final plat request from the February 28, 2006 <br />agenda. Staff inadvertently pulled the easement vacation request along with the final plat <br />request. At the February 28® meeting, City Staff recommended that because the hearing was <br />advertised, City Council should reinstate the case on the agenda. Council did so, called the <br />hearing to order and reconvened the heating to March 14th (the new meeting date for final plat <br />consideration). No further notice to residents was required as the announcement to reconvene <br />~vas made at a public meeting. However, interested residents weren't present to hear the <br />announcement as they thought no cases related to Brookfield Addition would be discussed on <br />February 28th. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br /> <br />Site location map <br />Exhibit of underlying easements to be vacated <br />Proposed Ordinances <br /> <br />Notification: <br /> <br />In accordance with State Statute, City Staff attempted to notify property owners within 350 feet <br />of the subject property of the public hearing to vacate easements. <br /> <br />Observations: <br /> <br />When the easement vacation hearing was reconvened on March 14th, residents expressed concern <br />with the confusion in hearing dates. Therefore, upon City Staff's recommendation, City Council <br />adjourned the hearing and scheduled a second public hearing regarding the easement vacation for <br />March 28th. <br /> <br />The plat of Brookfield eliminates the need for Marble Street N.W. and 167th Avenue N.W., <br />adjacent to Lot I, Block 1, Westby First Addition. The plat of Brookfield also replats Lot 1, <br />Block 1, Westby First Addition and eliminates the need for the standard drainage and utility <br />easements along the property lines of that lot. Council granted final plat approval to Brookfield <br />First Addition on March 14, 2006 contingent on approval of the requests for easement vacation. <br /> <br />-173- <br /> <br /> <br />
