CASE <br /> <br />REQUEST FOR AN EXTENSION OF TIME TO INITIATE AND <br />UTILIZE VARIA~NCE; CASE OF JEFF & JILL STEVENSON <br /> By: Chris Anderson, Zoning & Recycling Coordinator <br /> <br />Background: <br /> <br />On April 7, 2005, the Board of Adjustment approved Jeff & Jill Stevenson's request for a <br />variance to construct a detached garage closer to the front property line than the home. City <br />Code Section 9.03.07 (Variances) states that a variance shall become nuI1 and void one (1) year <br />after the final action of the Board of Adjustment if it is not initiated or utilized. A variance <br />holder may petition for an extension of time to utilize the variance through a written request. <br />Such requests are to be presented to City Council for decision. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Letter from Applicants <br />b) Site Plan <br /> <br />Observations: <br /> <br />The S~evensons own a lot in the Northfork St. Andrews Addition. They had planned to construct <br />a new home and detached garage on the lot last fall. Due to extenuating circumstances, the <br />Stevensons have yet to apply for their building permit (which would constitute initiation of the <br />variance). They are requesting an extension of time to enable them to utilize this variance. The <br />site conditions have not changed since the variance was approved nor has the site plan. <br /> <br />Recommendation: <br /> <br />Staff recommends approving the Stevensons request for an extension of time to utilize their <br />variance until October 7, 2006 <br /> <br />Council Action: <br /> <br />Motion to grant a six (6) month extension to utilize a variance to construct a detached garage <br />closer to the front property line than the home. <br /> <br />-or- <br /> <br />Motion to deny the request for an extension of time to utilize a variance to construct a detached <br />garage closer to the front property line than the home. <br /> <br />Reviewed by: <br />Asst.
