VII. <br /> <br />VIII. <br /> <br />IX. <br /> <br />XIo <br /> <br />each playing season with a policy of public liability insurance in a reasonable amount to be agreed <br />upon by the City. <br /> <br />FOOD/DRINK SALES <br />All food or drink prepared, served, sold, or stored shall be done so in strict conformity with all <br />City ordinances, county, state and federal statutes. <br /> <br />CRIMINAL BACKGROUND CHECKS <br />One of the primary goals of the City is to continually ensure the safety and welfare of its youth <br />during their participation in all sports and athletic activities that occur on or in City athletic <br />facilities. The School shall conduct criminal background checks on all persons acting as head <br />coaches, board members and any other person acting in an official capacity with any organization <br />directly overseeing their youth activities. These checks shall be conducted prior to the beginning <br />of each playing season and shall remain valid for the calendar year. The School shall employ a <br />reputable company licensed by the State of MN to conduct such checks. The School shall also <br />maintain and publish a criminal background check policy to be used for determining an <br />individual's eligibility to coach. Should an individual be disqualified as a result of the check, the <br />School will prohibit that individual from serving in any official capacity with school activities. <br /> <br />SCHEDULES <br />The School shall furnish to the City a full schedule for each seasonal sport(s) requiring the use of <br />the Premises within thirty (30) days prior to the beginning of each playing season. Any additions <br />or changes to any schedules requiring the use of the Premises will be submitted as a supplement to <br />the City. <br />The School shall have use of the premises on each school day from 8:00 a.m. to 5:30 p.m. or 6:00 <br />p.m. for the purposes of physical education classes and other education and extracurricular <br />activities. <br />Additional activities will be negotiated with the City based upon availability (i.e. weekend <br />tournaments, all school functions). <br /> <br />USER FEES <br />The School shall pay the City $500 for the right to use the field(s) during the first Calendar year, <br />and then at an agreed to amount thereafter. In addition, the School will pay the City for field <br />maintenance consistent with fees charge by the City to other youth athletic organizations. <br /> <br />USE BY CITY <br />The City reserves the right to utilize the Premises when school games, practices and activities are <br />not scheduled. Further, the City may preempt the schools scheduled use of the premises, if it is <br />deemed to be reasonable and in the City's interest to do so. The City shall attempt to provide at <br />least 7 days notice for any such occurrence. <br /> <br />OFFICERS AND BOARD MEMBERS <br />The School shall submit to the City the names, addresses and phone numbers of all current board <br />members at least thirty (30) days prior to the beginning of each playing season. The School shall <br />also post on their Internet web site a copy of their most current board roster and contact <br />information, constitution, bylaws, criminal background check policy, grievance procedures and <br />playing roles. The School shall post any adopted changes to this information in a timely manner, <br />as an update to their Intemet Web site. If the School does not have an Internet web site, they shall <br />make a hard copy available to the public when requested. <br /> <br /> 2 <br />-343- <br /> <br /> <br />
