j. PROPOSAL REQUIR~v~ 5%w1~ This request for proposals contains selected requirements as determined by t_he cities and the C~,~.~ssion. The cities are establishing few requirements, as they desire that all applicants have maximum freedcm to develop their own innovative proposals. The c~,~nications needs reports stmm~rizing the reports made by individual advisory bodies to their City Councils based on assessing ccmr~nity needs is attached. The report also contains statem~_nts frcra possible system users. Applicants are advised to take this report and the individual reports of the citizens advisory bodies into consideration in developing proposals. Further, applicants should carefully review all requirements and conditions set forth in the preliminary ordinance, and familiarize themselves with the rules of the Minnesota ~ahle Cu~'~nications Board and Chapter 238 of the Minnesota Statutes. The citie~ fully expect to enter into firm contracts with the successful applicant for the timely delivery of all elements of the applicant's proposal. All items being offered by applicants are considered to be freely and voluntarily offered and will be included in the franchises and beccme subject to the franchise enforcement provisions. The successful applicant must agree to suppoz~ any wmiver required by the Federal Cu~u~nications Conmission for any voluntary offer or services or technical star,lards that may exceed FCC requirements. All applicants will be required to: 1. Extend cable television service throughout the four cuyf~nities in areas with a density of 40 or more hc~es per cable mile*' within tkree years of the date of the grant of the franchise. 2. Meet or exceed all FCC technical standards. 3. Construct cable plant underground where other utilities are underground and change frem aerial to underground when any of the utilities so change. Any change form aerial to underground shall be at the franchisee's expense. 4. Cu~ly with all applicable laws, ordinances, rules, regulations, and cedes, federal, state, and local, relating to construction and construction staDdards. Franchisee shall not open or disturb the surface of any streets or public property without first obtaining a pezmit fr~n the cities. Any work done shall be in a workmanlike manner and shall not er~anger the health or safety of the citizenry. Any work done shall result in the returning of the street or public property to good condition at the expense of the franchisee. Franchisee shall further cc~ply with all construction star~ards proposed in the prellmin~ry, draft ordinance. * The C~,,'L%ission recognizes that scum housing develoIm~ents in Andover and Ramsey and one develo~nent in Champlin may have 40 hc~es per cable mile but may also be situated far enough frc~n other population areas so as .to make initial service econc~ically unreasonable. The C~,'~%isssion desires service to the greatest number of hc~es in the shortest period of tin~ for the most reasonable rates. ~mhle cc~,ganles should design their system to meet these goals, atten~oting to service as many isolated areas as is possible, and econcmically feasible.
