j. PROPOSAL REQUIR~v~ 5%w1~ <br /> This request for proposals contains selected requirements as determined by <br /> t_he cities and the C~,~.~ssion. The cities are establishing few requirements, <br /> as they desire that all applicants have maximum freedcm to develop their own <br /> innovative proposals. The c~,~nications needs reports stmm~rizing the reports <br /> made by individual advisory bodies to their City Councils based on assessing <br /> ccmr~nity needs is attached. The report also contains statem~_nts frcra possible <br /> system users. Applicants are advised to take this report and the individual reports <br /> of the citizens advisory bodies into consideration in developing proposals. Further, <br /> applicants should carefully review all requirements and conditions set forth in the <br /> preliminary ordinance, and familiarize themselves with the rules of the Minnesota <br /> ~ahle Cu~'~nications Board and Chapter 238 of the Minnesota Statutes. <br /> The citie~ fully expect to enter into firm contracts with the successful <br /> applicant for the timely delivery of all elements of the applicant's proposal. All <br /> items being offered by applicants are considered to be freely and voluntarily offered <br /> and will be included in the franchises and beccme subject to the franchise enforcement <br /> provisions. The successful applicant must agree to suppoz~ any wmiver required by the <br /> Federal Cu~u~nications Conmission for any voluntary offer or services or technical <br /> star,lards that may exceed FCC requirements. <br /> <br />All applicants will be required to: <br /> <br />1. Extend cable television service throughout the four cuyf~nities in areas <br /> with a density of 40 or more hc~es per cable mile*' within tkree years of <br /> the date of the grant of the franchise. <br /> <br />2. Meet or exceed all FCC technical standards. <br /> <br />3. Construct cable plant underground where other utilities are underground and <br /> change frem aerial to underground when any of the utilities so change. Any <br /> change form aerial to underground shall be at the franchisee's expense. <br /> <br /> 4. Cu~ly with all applicable laws, ordinances, rules, regulations, and cedes, <br /> federal, state, and local, relating to construction and construction <br /> staDdards. Franchisee shall not open or disturb the surface of any streets <br /> or public property without first obtaining a pezmit fr~n the cities. Any <br /> work done shall be in a workmanlike manner and shall not er~anger the health <br /> or safety of the citizenry. Any work done shall result in the returning of <br /> the street or public property to good condition at the expense of the <br /> franchisee. Franchisee shall further cc~ply with all construction star~ards <br /> proposed in the prellmin~ry, draft ordinance. <br /> <br />* The C~,,'L%ission recognizes that scum housing develoIm~ents in Andover and Ramsey and <br /> one develo~nent in Champlin may have 40 hc~es per cable mile but may also be <br /> situated far enough frc~n other population areas so as .to make initial service <br /> econc~ically unreasonable. The C~,'~%isssion desires service to the greatest number <br /> of hc~es in the shortest period of tin~ for the most reasonable rates. ~mhle <br /> cc~,ganles should design their system to meet these goals, atten~oting to service as <br /> many isolated areas as is possible, and econcmically feasible. <br /> <br /> <br />
