Gamec T+ <br />Mayor of Ramsey D o" <br />15153 Nowthen Boulevard N.W. <br />Ramsey, Minnesota 55303 S3£2 SSLU'2 <br />Dear Mayor Gamec: <br />This is in reply to your letter of March 10, 1981, requesting information <br />on the allotment of Municipal State -Aid Street funds and your allotment <br />of Local Government Aid to Cities. <br />The Municipal State -Aid Street allotment is from the Road User Fund and <br />is administrated within the Department of Transportation. Minnesota <br />Statutes Chapter 162.09, Subd. 4 provides: In determining whether any <br />city has a population of 5,000 or more, the last federal census shall be <br />conclusive; provided, that if an entire area not heretofore incorporated <br />as a city is incorporated as such during the interval between federal <br />censuses, its population shall be determined by its incorporation census. <br />The incorporation census shall be determinative of the population of the <br />city only until the next federal census. <br />Therefore, the population figures as certified by the Secretary of State <br />as of December 31 of each year are used in making the apportionment. <br />The Department of Transportation Rules 14 MCAR 3 1.5032, Section F. - <br />states that the Commissioner of Transportation must certify the annual <br />• apportionment on or before January 25-of each year. <br />The Department of Revenue uses Chapter 275.53'in making the apportionment <br />of Local Government Aid to Cities. <br />275.53 GOVERNING CENSUS. <br />Subdivision 1. For the purpose of determining the amount of tax <br />that a governmental subdivision may levy in accordance with a per capita . <br />limitation established by this chapter or the amount of aid that a city <br />or township may receive pursuant to section 477A.01, the population of <br />the governmental subdivision shall be that established by the last <br />federal census, by a census taken pursuant to subdivision 2, or by a <br />population estimate of the state demographer made pursuant to section 4.12,. <br />subdivision 7, clause (10), whichever is the most recent as to the stated <br />date of count or estimate, up to and including July 1 of the current levy <br />year. Population changes established after July 1 of the current levy <br />year shall not be used in determining the levy limitation of a governmental <br />subdivision for the current levy year under sections 275.50 to 275.56. <br />AN EQUAL OPPORTUNITY EMPLOYER (� <br />��pg <br />
