On August 18, 1978 <br />the city of Ramsey was notified of the statutory requirement to adopt an <br />ordinance to regulate development within the Scenic River District. On <br />July 7, 1979, the City was given a six-monna deadline to adopt such an <br />ordinance, and this deadline was subsequently extended twice by the DNR <br />until September 20, 1980 to allow the City time to develop adequate controls. <br />As of this date, the City of Ramsey has failed to adopt an ordinance which <br />complies with the DNR regulations NR 78-81, Rules and Regulations of the <br />Department of Natural Resources Relating to Wildt Scenic and Recreational <br />~ivers S~stem, and the Management Plan for the Rum River (6 MCAR §§ 1.27u0- <br />1.2720). The DNR has made its position clear in meetings held with the <br />City of Ramsey on September 16, 1980 and January 26, 1981 as to the accep- <br />table minimum standards'which will comply with State regulations. <br /> <br />The City of Ramsey must adopt compliant land use controls for the Rum River <br />within sixty {60) days of receipt of this letter. If the city fails to <br />adopt such controls, the Department of Natural Resources will proceed to <br />adopt a scenic river ordinance for the City in accordance with Minnesota <br />Statutes, ~ 104.36, Subdivision 1~ Be advised that the above statute allows <br />the Department to charge the City of Ramsey for all costs incurred in the <br />adoption process. <br /> <br /> The Minnesota Wild and Scenic Rivers Act was enacted by the Legislature in <br /> order to provide for wise utilization of the state's water and related shore- <br /> land areas in a manner which benefits the public health, safety, and welfare <br /> for future generations. The Department of l~tural Resources urges the City <br /> of Ramsey'to expeditiously act toward this goal by adopting a Scenic River <br /> Ordinahc~ which complies with State requirements.
