CASE <br /> <br /> PUBLIC HEARING <br />REQUEST FOR A VARIANCE TO MINIMUM LOT SIZE IN THE TOWER OVERLAY <br />DISTRICT FOR A MONOPOLE COMMUNICATIONS TOWER; <br /> CASE OF CINGULAR WIRELESS, INC <br /> By: Chris Anderson, Zoning & Recycling Coordinator <br /> <br />Background: <br /> <br />The City has received an application from Cingular Wireless to construct and operate a <br />monopole communications tower intended to fill a gap in Cingular's wireless phone network. <br />The proposed tower will be located at 6405 Green Valley Road, which is about 9.27 acres and <br />owned by Jeffrey and Caroline Rowe. A conditional use permit is also required for the <br />construction of a communications tower and that request, which was tabled at the March meeting <br />due to the need for a variance to minimum lot size, will be presented during the Plarming <br />Commission meeting. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Site location map <br />Tower Overlay District Map <br />Site plan showing Iocation of tower on property. <br />Proposed findings of fact <br />Proposed variance <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to property owners within 350 feet of the <br />subject property. Staff sent out notices to all property owners within 350 feet. <br /> <br />Observations: <br /> <br />Towers am permitted in residential districts as long as they are located within the Tower Overlay <br />District (see attached map) and the proposed tower site is at least 10 acres. The subject property, <br />which is zoned R-1 Rural Preserve, is located within the Tower Overlay District but does not <br />meet the minimum lot size requirement. The subject property, Lot 4, Block 1, Valley View <br />Estates, is approximately 9.27 acres. The minimum lot size in this zoning district is 10 acres. <br /> <br />As part of the Valley View Estates plat, which was approved in 2000, four lots were created, <br />each less than 10 acres. The original parcel was 38.7 acres and under City Ordinances was <br />allowed to create four new lots. The developer received a variance for Lots 1-3 for lot size and <br />lot width. Lot 4 (the subject property), was allowed to be created as a remnant parcel per City <br />Ordinances. When Lot 4 was created, the County requested an additional twenty-seven (27) feet <br /> <br /> <br />
