If the right-of-way is included, Lot <br /> 4 is approximately 10.3 acres. <br /> <br />Recommendation: <br /> <br />While the lot size is just short of that required by City Code, Staff believes that this is a valid <br />request, based on several factors. First, standards of City Code permitted the creation of this Iot <br />as a remnant parcel. Secondly, if the right-of-way area is included, this lot would exceed the <br />minimum size requirements. Therefore, Staff is recommending that the request be approved. <br /> <br />Board Action: <br /> <br />Motion to adopt Resolution #06-04- adopting Findings of Fact # relating to Cingular <br />Wireless' request for a variance to Section 9.15.03 of the Ramsey City Code regarding minimum <br />lot size requirements for communications towers in the Tower Overlay District. <br /> <br />-and- <br /> <br />Motion to approve Cingular Wireless' request for a variance to minimum lot size requirements <br />for communications towers in the Tower Overlay District based on the findings of fact and adopt <br />Resolution #06-04- declaring terms of same. <br /> <br />-or- <br /> <br />Motion to deny Cingular Wireless' request for a variance to minimum lot size requirements for <br />communications towers in the Tower Overlay District based on the findings of fact. <br /> <br />Review Checklist: <br />Asst.
