Councilmember moved for the adoption of the following findings of fact: <br /> <br />RESOLUTION #06-04- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR A 120-FOOT MONOPOLE <br />COMMUNICATIONS TOWER. <br /> WltEREAS, Cingular Wireless, Inc., hereinafter referred to as "Applicant", has properly <br />applied for a Conditional Use Permit to construct and operate a monopole communications tower <br />("Tower") on the property located at 6305 Green Valley Rd. and legally described as follows: <br /> Lot 4, Block 1, Valley View Acres, Anoka County, Minnesota <br /> <br /> (the "Subject Property"). <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the Applicant appeared before the Planning Commission for a public hearing <br /> pursuant to Section 9.03.05 of the Rarnsey City Code on April 6, 2006, and that said <br /> public hearing was properly advertised and that the minutes of said public hearing are <br /> hereby incorporated by reference. <br /> <br />2. That the Subject Property is located in the R-1 Rural Preserve and is approximately 9.27' <br /> acres in size, and is owned by Jeff and Caroline Rowe. <br /> <br />3. That the Subject Property is located in the Tower Overlay District which allows for <br /> communications towers up to 120 feet in height on parcels that are greater than 10 acres. <br /> <br />4. That the Applicant has submitted a variance to the minimum lot size .requirement in order <br /> to allow for a communications tower to be constructed on the Subject Property. <br /> <br /> 5. The Applicant's variance request will be considered by the Board of Adjustment on April <br /> 6, 2006. <br /> <br /> 6. That the Applicant is proposing to lease a 50 foot by 65 foot portion of land on the <br /> Subject Property (Site) to facilitate the construction and operation of the Tower. <br /> <br /> 7. That the property to the north and west are zoned R-1 Rural Preserve and the properties to <br /> the south and east are zoned R-l Rural Developing. <br /> <br /> 8. That the Applicant is proposing to construct a 120-foot monopole communications tower <br /> with a fenced in 50' x 65' equipment area, which will also contain an equipment shelter <br /> that will be 12' x 20'. <br /> <br /> 9. That City Code establishes a setback for towers of one and half times the height of the <br /> tower. <br /> <br /> 10. That the proposed tower located on the Subject Property. will need to be at least 180 feet <br /> from any property line. <br /> <br />9 <br /> <br /> <br />
