10 11. That the proposed tower will be located at least 195 feet from any property line. 12. That the Tower base and equipment building will be completely enclosed with cyclone fencing, which, for security purposes, will also include barbed-wire around the top of the fence that is at least six (6) feet above pound level. 13. That the Applicant has stated that there will be no personnel stationed at the site and the base of the Tower will be encompassed by a security fence to prevent unauthorized entry. 14. That the Applicant has stated that access to the Subject Property Will be from a ~avel driveway and that no parking will be required because site visits will be infrequent and of limited duration. 15. That City Code states that no new tower shall be approved unless the City Council finds that the equipment planned for the proposed tower cannot be accommodated on an existing or approved tower or building within a I-mile radius of the proposed tower for various reasons including insufficient height to reasonably function. 16. That the Applicant has stated that there are no existing buildings or structures in the 1- mile search area of a sufficient height to accommodate the proposed equipment and provide a strong, seamless signal. I7. That City Code requires newly constructed towers to accommodate at least two additional users; the Applicant has stated that the Tower design would permit at least two additional users. 18. That the proposed use Will/will not substantially impair the use or market value of surrounding properties. 19. That the proposed use will/will not be unduly dangerous or otherwise detrimental to persons working in the vicinity of the use, or to the public welfare. 20. 2I. That the proposed use will/will not be hazardous or disturbing to existing or future neighboring uses. That the proposed use Will/will not be served adequately by essential public facilities and services. 22. That the proposed use will/will not create excessive additional requirements at public cost for public facilities and services and will/will not be detrimental to the economic welfare of the community. 23. That the proposed use will/will not involve equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare, or odors. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember , and upon vote being taken thereon, the following voted in favor thereof: RESOLUTION #06-04- Page 2 of 3
