Subd. 2. Lot of Record. The determination of the status of an individual lot as being a <br />lot of record recognized by the City of Ramsey City Council as being a duly recorded lot for <br />which the City will issue a building permit or other such applicable permit shall be made in <br />accordance with the provisions of the City's Zoning code and Subdivision Regulations or <br />amendments thereto. <br /> <br /> Subd. 3. Nonconforming Lots and Uses. Nonconforming lots and/or uses which do not <br />meet the minimum requirements of this Code, the City's Zoning Code and Subdivision <br />Regulations and other applicable codes of the City shall have a lawful non-conforming status and <br />be regulated under the provisions of the Ramsey Zoning Code. <br /> Subd. 4. Minimum Lot Requirements in the Mississippi River Overlay District. Any lot <br />located within the Mississippi River Overlay District shall: <br /> <br /> a. Meet the minimum requirements' for the particular base zoning district if the lot was <br /> platted prior to [effective date of the Mississippi River Overlay District]. <br /> b. Existing lots as of [effective date of the Mississippi Pdver Overlay District] may not <br /> be subdivided unless the remnant portion of the original lot and the newly subdivided <br /> lot meet the requirements of this section. <br /> <br /> c. If the land is platted after the effective date of the Mississippi River Overlay District, <br /> the development shall: <br /> <br /> 1. not exceed the net density of the underlying zoning district. <br /> <br /> 2. be developed under a Planned Unit Development (PUD) as contained in Section <br /> 9.20.31, with conservation subdivision design principles incorporated to cluster <br /> development and minimize the impact on natural resources. <br /> <br /> 3. preserve 50% of the land within the development as open space. Riverfront open <br /> space is a priority in the Mississippi River Overlay District. The City will <br /> determine if the open space will be public, private, or a combination thereof. <br /> 4.minimize site alterations and minimize street and infrastructure development to <br /> reduce negative environmental impact. <br /> <br /> 5. contain specific conditions relative to buffering landscaping and revegetation. <br /> <br /> 6. Incorporate the goals and policies for establishing a continuous trail corridor <br /> along or near the Mississippi River. <br /> <br /> 7. Not exceed 25% impervious surface unless approved by CUP. Impervious <br /> surface will be calculated for the overall development site. <br /> <br />d. No multiple residential uses shall be permitted in unsewered areas. <br /> <br />e. Parcels that are 3 acres or smaller and non-riparian that are proposed to be subdivided <br /> within the Overlay District are exempted from the PUD and open space requirements <br /> <br />-16- <br /> <br /> <br />
